RESOLUTION OF THE SAN RAFAEL CITY COUNCIL
ADOPTING A GENERAL PLAN AMENDMENT TO CHANGE
THE LAND USE DESIGNATION ON 157 WOODLAND
AVENUE FROM HILLSIDE RESIDENTIAL TO LOW DENSITY
RESIDENTIAL AND TO AMEND APPENDD( B TO
DESIGNATE 12 TRIPS FOR THE SITE
(APN 13-114-19 AND -20)

WHEREAS, on March 3, 1995 an application for a General Plan Amendment to change the
Land Use Designation from Hillside Residential to Low Density Residential and to amend
Appendix B to designate 12 trips for the site was found by the Planning Department to be
complete for processing; and,
WHEREAS, upon review of the subject application a Mitigated Negative Declaration was
prepared consistent with the requirements of the California Environmental Quality Act
(CEQA); and,
WHEREAS, notification of the proposed GPA94-2 amendment occurred as specified by law;
and,
WHEREAS, staff identified the amendments, with corresponding background analysis in
the May 23, 1995 Report to Planning Commission; and,
WHEREAS, the San Rafael Planning Commission is required by state law to hold at least
one public hearing and make a written recommendation to the legislative body on the
adoption of any General Plan Amendments; and,
WHEREAS, the Planning Commission held a public hearing on May 23, 1995, to hear public
comments on the proposed amendments; and,
WHEREAS, the Planning Commission adopted a resolution recommending approval of
the proposed General Plan Amendments (GPA94-2) on May 23, 1995; and,
WHEREAS, the City Council held a public hearing on the General Plan Amendments on
June 19, 1995; and,
WHEREAS, the City Council has adopted by separate resolution the Mitigated Negative
Declaration, including the Mitigation Monitoring Program, for the project, and
WHEREAS, the City Council considered all verbal and written testimony on the General
Plan Amendments; and,
WHEREAS, the City Council determined that the public interest is served by the adoption
of the proposed General Plan amendment because the amendment is not in conflict with
other General Plan Policies and the Low Density Residential land use designation is
consistent with the prevailing land use pattern. The project has been designed to fit the
existing neighborhood. The two single family lots on Bret Harte Road are consistent with

the Low Density Residential Designation and the single family lot pattern of the adjacent
properties. The clustered townhouses on the lower lot are compatible with the adjacent
Medium and High Density land use designations. .
NOW, THEREFORE, BE IT RESOLVED, that the San Rafael City Council adopts the General
Plan Amendment changing the land use designation from Hillside Residential to Low
Density Residential as shown on the attached map, Exhibit A, and amending Appendix B to
designate 12 trips for the site.
The foregoing resolution was duly and regularly introduced and adopted at a regular
meeting of the San Rafael City Council held on the 19th day of June, 1995, by the following
vote, to wit:
