HomeMy WebLinkAboutCC Resolution 9289 (Oakview School Site Land Use Designation)RESOLUTION 9 2 8 9 RESOLUTION OF THE SAN RAFAEL CITY COUNCIL ADOPTING GENERAL PLAN AMENDMENT TO CHANGE THE LAND USE DESIGNATION ON A PORTION OF THE OAKVIEW SCHOOL SITE PARCEL FROM LOW DENSITY RESIDENTIAL TO PUBLIC/QUASI-PUBLIC (APN 165-010-54) (GPA94-3) WHEREAS, on September 16, 1994, an application for a General Plan Amendment to change the Land Use Designation from Low Density Residential to Public/Quasi-Public was found by the Planning Department to be complete for processing; and, WHEREAS, upon review of the subject application a Mitigated Negative Declaration was prepared consistent with the requirements of the California Environmental Quality Act (CEQA); and, WHEREAS, notification of the proposed GPA94-3 amendment occurred as specified by law; and, WHEREAS, staff identified the amendments, with corresponding background analysis in the December 13, 1994 Report to Planning Commission; and, WHEREAS, the San Rafael Planning Commission is required by state law to hold at least one public hearing and make a written recommendation to the legislative body on the adoption of any General Plan Amendments; and, WHEREAS, the Planning Commission held a public hearing on December 13, 1994, to hear public comments on the proposed amendments; and, WHEREAS, the Planning Commission adopted a resolution recommending approval of the proposed General Plan Amendments (GPA94-3) on December 13, 1994; and, WHEREAS, the City Council held a public hearing on the General Plan Amendments on January 17,1995; and, WHEREAS, the City Council has adopted by separate resolution the Mitigated Negative Declaration, including the Mitigation Monitoring Program, for the project; and, WHEREAS, the City Council considered all verbal and written testimony on the General Plan Amendments; and, WHEREAS, the City Council determined that the public interest is served by the adoption of the proposed General Plan amendment because the amendment is not in conflict with other General Plan Policies and it will permit the existing non-profit uses which provide needed services to the community to remain at the site. �RlGlNA1 �xB9 NOW, THEREFORE, BE IT RESOLVED, that the San Rafael City Council adopts the General Plan Amendment changing the land use designation from Low Density Residential to Public/Quasi-Public on a portion of the Oakview School site located at 70 Skyview Terrace (APN 165-010-54) as shown on the attached map, Exhibit A: The foregoing resolution was duly and regularly introduced and adopted at a regular meeting of the San Rafael City Council held on the 17th day of January, 1995, by the following vote, to wit: AYES: COUNCILMEMBERS : Heller, Zappetini and Vice -Mayor Cohen NOES: COUNCILMEMBERS : None ABSENT: COUNCILMEMBERS : Mayor Boro Jea�MLeoncini, City Clerk ExHIB IT „A ff Portion of Change FrOM School Site of P om Low Density Rite of t a Posed Land Use to Public/Quasi-Public
