HomeMy WebLinkAboutCC Resolution 9228 (Oakwood Subdivision Unit 2)RESOLUTION NO. 9 2 2 8 RESOLUTION OF THE SAN RAFAEL CITY COUNCIL APPROVING A SUBDIVISION MAP AMENDMENT (OAKWOOD SUBDIVISION UNIT #2; LOTS 18A AND 19A) S94-6 162 and 166 Greenwood Avenue, AP#s 12-320-06 and 07 WHEREAS, an application for a subdivision map amendment to enlarge the building envelopes on Lots 18A and 19A in Oakwood Subdivision Unit #2, was submitted; and WHEREAS, on August 23, 1994, the Planning Commission of the City of San Rafael reviewed and considered public testimony and the staff report at a duly noticed public hearing on the subdivision map amendment application and recommended to the City Council approval of the subdivision map amendment; and WHEREAS, on September 19, 1994, the City Council reviewed and considered public testimony and the staff reports on the project application for the proposed subdivision map amendment. NOW THEREFORE BE IT RESOLVED, that the San Rafael City Council approves the subdivision map amendment (s94-6) to enlarge the building envelopes on Lots 18A and 19A of Oakwood Subdivision Unit #2 based on the specific findings pertaining to the project approvals contained in Exhibit A to this Resolution. I, JEANNE M. LEONCINI, Clerk of the City of San Rafael, hereby certify that the foregoing resolution was duly and regularly introduced and adopted at a regular meeting of the Council of said City on Monday the Nineteenth day of September, 1994, by the following vote, to wit: AYES: COUNCILMEMBERS: Cohen, Heller, Thayer, Zappetini & Mayor Boro NOES: COUNCILMEMBERS.: None ABSENT: COUNCILMEMBERS: None JfZ N-( ONCINI, City Clerk ORIGINAL ��«x FINDINGS: 1. The enlargement of the building envelopes on Lots 18A and 19A is consistent with the General Plan 2000 land use designations of Hillside Residential (.5-20 units an acre) and Low Density Residential (2.0-6.5 units an acre) in that the proposal does not involve modifications to the allowed density of the properties. 2. The modifications to the building envelopes of Lots 18A and 19A are consistent with the zoning classification of R20 -H in that the proposal does not involve modifications to the required lot area or dimensions of the district. 3. The proposed modifications are not likely to cause substantial environmental damage or be detrimental to the public health, safety or general welfare of the surrounding property owners or the City as a whole. CONDITIONS OF APPROVAL: FIRE DEPARTMENT 1. Based on the required fire flow, an automatic residential fire sprinkler system shall be installed throughout conforming to NFPA Std. 13D as modified by the Fire Marshal. 2. Due to the wildlife fire interface area, fire retardant roof covering is required with a minimum Class "A" listing. 3. A minimum 30' wide break (brush clearing) shall be maintained around structures. PLANNING DEPARTMENT 4. All previous conditions of approval for TS76-8(d) pertaining to the Oakwood Unit #2 portion of the subdivision shall be required. S. Design Review shall be required prior to the issuance of building permits for construction of the homes. All site improvements shall be consistent with the City's Hillside Design Guidelines, including any proposed grading and tree removal. The placement and configuration of the building envelopes do not constitute automatic approval for tree removal. On-site trees shall not be removed unless authorized by an Environmental and Design Review permit. A soils report shall also be submitted, as part of the design review process, to insure that the proposed development is feasible. 6. The driveway for Lot 18 shall be designed by a licensed civil engineer and approved by the Public Works Director. 7. A legal instrument reflecting the lot building envelopes shall be submitted to the City Attorney and Planning and Public Works Departments for approval prior to recordation. 8. This subdivision map amendment is approved for two years, or until August 23, 1996 and shall be null and void unless an approved legal document reflecting the building envelopes is recorded. EX B! T A
