RESOLUTION DECLARING SURPLUS AND
AUTHORIZING APPLICATION THEREOF
KERNER BOULEVARD ASSESSMENT DISTRICT
The City Council of the City of San Rafael resolves:
On November 15, 1982, the City Council adopted its Resolution of Intention
No. 6447, as later amended, for public improvements in Kerner Boulevard Assessment
District, City of San Rafael, Marin County, California.
Said Resolution of Intention, as later amended, provided that any surplus in
the improvement fund for said assessment, after completion of the improvements and
payment of all claims from the improvement fund, would be applied in accordance with
Section 10427 of the Streets and Highways Code of the State of California.
Said improvements have been completed and a Notice of Completion was
recorded in the office of the Marin County Recorder on February 24, 1986. All claims
upon the improvement fund have been paid.
1. A balance of $192,874.00 remains in the improvement fund for
Kerner Boulevard Assessment District, and said amount is surplus.
2. The amount of $192,874.00 shall be utilized for the maintenance of
the improvements constructed in said proceedings pursuant to said Resolution No. 6447
of Intention, as later amended, as authorized by Section 10427 of the Streets and
Highways Code of the State of California and as more specifically set forth in Exhibit A
attached hereto.
3. The Clerk is directed to provide a certified copy of this resolution to
the City Treasurer of the City of San Rafael.
I, JEANNE M. LEONCINI, Clerk of the City of San Rafael, California, hereby
certify that the foregoing resolution was duly and regularly introduced and adopted at a
regular meeting of the Council of said City held on the 7th day of November, 1994, by the
following vote, to wit:

Dear Ed:
This is to donfirtn your telephone conversation yesterday with Tom Orpvich
regarding an available surplus -of approximately $192,000 still existing in the
Kerner Blvd. Assessment District.
You had soecilkglly inquired as to Why we would need that much Mpney
declared surplus and how was -it going to be spent.
This is to advi4e you that any funds declared surplus within the Kerner Blvd.
Assessment District will be used for maintenance purposes involving the
resurfacing of various streets within the District, the reconstruction of a
portion of Kerner. Blvd., which has experienced significant settlement, and
for maintenance of drainage facilities, i.e., storm drain -pipes, man1joles,
catch basins, etc.
