HomeMy WebLinkAboutCC Resolution 9185 (CSA 19 Fire Protection Services)RESOLUTION NO. 9185 A RESOLUTION AUTHORIZING THE SIGNING OF A CONTRACT, LEASE OR AGREEMENT THE CITY COUNCIL OF THE CITY OF SAN RAFAEL RESOLVES as follows: The MAYOR and CITY CLERK are authorized to execute, on behalf of the City of San Rafael, a contract, lease or agreement with JOINT POWERS AGREEMENT - CSA 19 FIRE PROTECTION SERVICES AMENDMENT (THROUGH JUNE 30, 1998) a copy of which is hereby attached and by this reference made a part hereof. LEONC I, City Clerk JOINT POWERS AGREEMENT CSA 19 FIRE PROTECTION SERVICES AMENDMENT This Agreement, made and entered into this day of �►I�ST , 1994, by and between COUNTY SERVICE AREA 19 of the COUNTY OF MARIN, hereinafter referred to as "Service Area", and the CITY OF SAN RAFAEL, hereinafter referred to as "Contractor". WITNESSETH: WHEREAS, the parties to this agreement have entered into a Joint Powers Agreement dated May 19, 1986, for fire protection services to residents of County Service Area 19, as described in Exhibit A, attached hereto and by this reference incorporated herein. WHEREAS, it is the purpose of this amendment to agreement to provide continuance of these services and to fix a means and method of payment for such extended period. A. The amendments consist of the following: 1. For fiscal year 1994-95, and each subsequent year thereafter, Service Area agrees to pay Contractor an amount equal to the preceding year, increased by the percentage of salary increase granted to the City firefighters for that contract year. The term "salary increase" shall also include any increase in City contributions to firefighters retirement, as defined in terms of a percentage of salary. These amounts will be pay- able to the Contractor in two installments—on December 24 and April 24 of each year. 2. Service Area agrees to pay for Service Area's proportionate share of extraordinary capital costs (i.e., replacement of a fire truck destroyed by fire) above and beyond the normal replacement and maintenance costs necessary to fulfill the objectives of this Agreement. B. This Agreement shall continue in full force and effect, retroactive to July 1, 1994, through June 30, 1998. It is understood that Contractor, no later than April 1, 1998, will meet with County to negotiate services provided and sums payable to Contractor for fiscal year 1998-99 and beyond. C. In all respects save as enumerated in Sections A and B hereof, the Agreement of May, 1986 shall be in full force and effect. t IN WITNESS WHEREOF, the parties hereto have set their hand the date and year first above written.
