HomeMy WebLinkAboutCC Resolution 9186 (Baypoint Lagoons Landscaping District)RESOLUTION NO. 9186 RESOLUTION ABANDONING PROPOSED INCREASED ASSESSMENT, CONFIRMING AMENDED ENGINEER'S ANNUAL REPORT AND LEVYING AMENDED ASSESSMENT FOR FISCAL YEAR 1994-1995 BAYPOINT LAGOONS LANDSCAPING AND LIGHTING DISTRICT (Pursuant to the Landscaping and Lighting Act of 1972) The City Council of the City of San Rafael resolves: 1. Pursuant to Chapter 3 of the Landscaping and Lighting Act of 1972, the City Council directed CSW/Stuber-Stroeh Engineering Group, Inc., Engineer of Work for Baypoint Lagoons Landscaping and Lighting District, City of San Rafael, Marin County, California, to prepare and file an annual report for fiscal year 1994-1995. 2. The Engineer of Work filed his annual report on May 16, 1994, and the City Council adopted its resolution of intention to levy and collect assessments within the assessment district for fiscal year 1994-1995 and set two public hearings to be held on July 5, 1994, and July 18, 1994, which was continued to August 1, 1994, in the meeting place of the City Council located in the Chambers of the City Council, 1400 Fifth Avenue, San Rafael, California. 3. At the public hearings, the City Council afforded to every interested person an opportunity to make a protest to the annual report either in writing or orally, and the City Council has considered each protest. 4. The City Council finds that protests have been made by the owners of more than one-half of the area of the land to be assessed. This constitutes a majority protest and therefore, the proposed increased assessment is abandoned pursuant to Section 22593 of the Streets and Highways Code. 5. The City Council hereby confirms the diagram and the amended assessment as set forth in the amended annual report of the Engineer of Work on file with the City Clerk and hereby levies the amended assessment set forth therein for fiscal year 1994-1995.
