HomeMy WebLinkAboutCC Resolution 9133 (95 Raquet Club)RESOLUTION NO. 9133 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN RAFAEL (IN ITS CAPACITY AS THE BOARD OF APPEALS) GRANTING CONDITIONED APPROVAL OF AN APPEAL FROM STATE ACCESS REQUIREMENTS 95 RACQUET CLUB DRIVE, SAN RAFAEL WHEREAS, the City Council of the City of San Rafael, may serve as the Board of Appeals pursuant Health and Safety Code Section 19957.5 to hear appeals from State mandated access requirements of said Code and of the Government Code; and WHEREAS, the applicant for 95 Racquet Club Drive has appealed said access requirements before the City Council, acting as the Board of Appeals; and WHEREAS, following a noticed hearing in which said applicant was given full opportunity to be heard, the City Council, acting as the Board of Appeals, does hereby find as follows: 1. That access improvements will be made which will make the Club's lower floor, patio, playground, wading pool, lap pool, and hot tub accessible; 2. That the cost of providing accessible toilet rooms ($42,500) is excessive when compared to the proposed project ($47,430); 3. That the Rafael Racquet Club will provide a temporary portable toilet facility until such time as they are able to remodel the existing toilet and shower facility. NOW, THEREFORE BE IT RESOLVED BY THE SAN RAFAEL CITY COUNCIL, ACTING IN ITS CAPACITY AS BOARD OF APPEALS, that in view of the foregoing findings, the appeal for relief from access requirements for 95 Racquet Club Drive, be and is hereby granted on condition that applicant provide an accessible temporary toilet facility in the path of travel until such time as the applicant is able to remodel the existing toilet and shower facility. I, JEANNE. M.
