HomeMy WebLinkAboutCC Resolution 9153 (Solid & Hazardous Waste JPA)RESOLUTION NO. 9153 A RESOLUTION OF THE SAN RAFAEL CITY COUNCIL TERMINATING THE AB939 SOLID WASTE MEMORANDUM OF UNDERSTANDING AND DESIGNATING THE MARIN COUNTY SOLID AND HAZARDOUS WASTE JOINT POWERS AUTHORITY AS THE AB939 TASK FORCE WHEREAS, the City of San Rafael has heretofore entered into a Memorandum of Understanding (MOU) dated July 3, 1990, between the County of Marin and the cities of Belvedere, Larkspur, Mill Valley, Novato, San Rafael and Sausalito, and the towns of Corte Madera, Fairfax, Ross, San Anselmo and Tiburon; and WHEREAS, with the adoption of the Marin County Solid and Hazardous Waste Joint Powers Authority, the parties to the MOU desire to terminate this Memorandum of Understanding, as provided for in Section 9 thereof, and; WHEREAS, according to the Public Resources Code, a Local Task Force must be appointed by the county and cities to assist in coordinating the development of the AB939 planning and implementation, and; WHEREAS, the Marin County Solid and Hazardous Waste Joint Powers Authority Board of Directors, comprised of representatives of the cities, the county and affected special districts is interested in also serving as the Local Task Force. NOW, THEREFORE, BE IT RESOLVED that the City of San Rafael does hereby: (1) Withdraw from the aforesaid Memorandum of Understanding; and (2) Appoint the Marin County Solid and Hazardous Waste Joint Powers Authority Board of Directors as the Local Task Force for AB939 planning; and (3) Delegate authority to the aforesaid Board of Directors to appoint up to seven additional members to the Task Force, to act in an advisory capacity, representing the solid waste industry, environmental organizations and the general public. I, JEANNE M. LEONCINI, Clerk of the City of San Rafael, hereby certify that the foregoing resolution was duly and regularly introduced and adopted at a regular meeting of the ORIGINAL ��,53 City Council of said City held on Monday, the sixth day of June, 1994, by the following vote, to wit: AYES: COUNCILMEMBERS: Heller, Thayer, Zappetini & Mayor Boro NOES: COUNCILMEMBERS: None ABSENT: COUNCILMEMBERS: Cohen JE E`M.
