A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
SAN RAFAEL APPROVING THE COST SHARING AGREEMENT
WITH CALTRANS FOR SHARING COSTS OF ELECTRICAL
FACILITIES ON STATE HIGHWAYS IN SAN RAFAEL
WHEREAS, the cost of maintaining and operating all electrical facilities
including traffic signals, flashers, and safety lighting, on any State highway and City
street/intersection, as shown in Exhibit "A", shall be the responsibility of the State:
and
WHEREAS, the cost of electrical energy to operate the electrical
facilities, as shown in Exhibit "A" mentioned above, shall be the responsibility of the
City; and
WHEREAS, these electrical facilities are located within the jurisdiction
of both the City and Caltrans, and each agency agrees to participate in the on-going
maintenance and cost of electrical energy in accordance with the Cost Sharing
Agreement: and
WHEREAS, it has been determined that the the City will save funds by
giving the State the responsibility for maintaining the existing and any new
installation of electrical facilities.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
San Rafael that the Cost Sharing Agreement which is attached hereto and made a
part hereof is approved and the Mayor and City Clerk are authorized to execute the
Agreement on behalf of the City of San Rafael.
I, JEANNE. M. LEONCINI, Clerk of the City of San Rafael, hereby certify
that the foregoing resolution was duly and regularly introduced and adopted at a
regular meeting of the Council of said City on Monday, the 7th day of February, 1994,
by the following vote, to wit:

AGREEMENT FOR SHARING COSTS OF STATE HIGHWAY ELECTRICAL
FACILITIES WITH THE CITY OF SAN RAFAEL
This AGREEMENT, made and executed in duplicate this day of
1994, by and between the State of
California, acting by and through the Department of Transportation, hereinafter
referred to as "STATE" and City of San Rafael hereinafter referred to as "CITY".
WITNESSETH:
AGREEMENT
This Agreement shall supersede any previous Agreement and/or Amendment
thereto for sharing costs of State maintained electrical facilities on State highways in
the CITY.
ELECTRICAL FACILITIES
"Electrical Facilities" include traffic signals, traffic signal systems, flashing beacons,
safety lighting and sign lighting on the STATE highway system as shown in Exhibit
A attached hereto.
Exhibit A will be revised as required to reflect changes in electrical facilities.
ELECTRICAL MAINTENANCE
The cost of maintaining and operating electrical facilities on any State highway and
any CITY street/road intersection as shown in Exhibit A shall be the responsibility of
the STATE.
ELECTRICAL ENERGY
The cost of electrical energy to operate the electrical facilities as shown in Exhibit A
shall be the responsibility of the CITY.
The cost of electrical energy to operate the electrical facilities as shown in Exhibit A
will be billed directly to the CITY by the Utility company.
It is agreed that monthly billings for CITY owned and maintained lighting will
remain the responsibility of the CITY.
TERM OF AGREEMENT
This Agreement shall become effective ,19 , and shall remain
in full force and effect until amended or terminated.
AMENDMENT /TERMINATION
This Agreement may be amended or terminated at any time upon mutual consent
of the parties acting by and through their authorized representatives.
This Agreement may also be terminated by either party, acting by and through that
party's representative, upon thirty (30) days written notice to the other party.
IN WITNESS WHEREOF, the parties hereto have set their hands and seals the day
and year first above written.
