A RESOLUTION OF THE SAN RAFAEL CITY COUNCIL
ASSIGNING AUTHORITY FOR SCENE MANAGEMENT
OF HAZARDOUS SUBSTANCE SPILLS WITHIN
THE CITY OF SAN RAFAEL, OTHER THAN ON
FREEWAYS, TO THE CITY OF SAN RAFAEL
FIRE DEPARTMENT
WHEREAS, Section 2454 of the California Vehicle Code
authorizes the local governing body of a city having jurisdiction
where on -highway hazardous substance spills occur to assign
authority for Management Scene, other than freeways, to either
the local law enforcement agency or fire protection agency; and
WHEREAS, the San Rafael City Council has afforded the
San Rafael Fire Department the training and equipment appropriate
for handling hazardous substance releases to include Scene
Management,emergency responses at both the operational and
technician levels; and
WHEREAS, the San Rafael Fire Department has developed a
Comprehensive Hazardous Materials Program for the City of San
Rafael to include inspections and emergency planning for facilit-
ies handling hazardous substance, site and transportation route
analysis for releases of extremely hazardous substances, and a
hazardous materials emergency response team; and
WHEREAS, the San Rafael Fire Department already has the
necessary expertise and organizational structure for handling
off-highway hazardous substance spills; and
WHEREAS, the flexibility of emergency management
provides for a unified command structure should the nature or the
scope of the incident escalate and for vesting overall control
in the City Manager should the magnitude of the incident so
necessitate;

NOW, THEREFORE, BE IT RESOLVED by the San Rafael City
Council that the Fire Department is hereby assigned authority for
Scene Management of on -highway hazardous substance spills when
occurring on local streets and roads, other than freeways, as
well as authority for Management of the Scene where an off-
highway hazardous substance spill occurs within the jurisdiction
of the City of San Rafael.

hereby certify that the foregoing resolution was duly and
regularly introduced and adopted at a regular meeting of the
Council of said City on 1 R1 -h day of October ,
1993, by the following vote, to wit:
