HomeMy WebLinkAboutCC Resolution 9022 (Loch Lomond #10 Drainage Easements)RESOLUTION NO. 9022 A RESOLUTION OF NECESSITY FOR ACQUISITION OF STORM DRAINAGE EASEMENTS FOR LOCH LOMOND UNIT #10 WHEREAS, the public interest and necessity require acquisition of easements for above ground or underground storm drainage across the real property hereinafter mentioned; and, WHEREAS, the proposed project, to -wit: replacement, reconstruction or relining of existing above ground or underground storm drainage easement pipes or channels, are planned or located in the manner that will be most compatible with the greatest public good and the least private injury; and, WHEREAS, the property to be the subject of the easement is described as follows: Legal Description of Storm Drainage Easement on: Assessor's Parcel No. 16-121-10 attached as Exhibit "A" Assessor's Parcel No. 16-122-07 attached as Exhibit "B" Assessor's Parcel No. 16-122-08 attached as Exhibit "C" Assessor's Parcel No. 16-122-09 attached as Exhibit "D" and, WHEREAS, an underground or above ground storm drainage easement across the property described above is necessary for the proposed project; and WHEREAS, the offer required by Section 7267.2 of the Government Code of the State of California has been made to the owner or owners of record, or the offer has not been made because the owner cannot be located with reasonable diligence; and WHEREAS, an easement for the purpose of underground or above ground storm drainage is a public use for which the City of San Rafael is authorized to acquire an interest in property under the California Government Code. NOW, THEREFORE BE IT RESOLVED, that the City Council of the City of San Rafael, California, does hereby adopt a Resolution of Necessity pursuant to Code of Civil Procedure, Section 1245.230 as follows: 1 R I G I N A L�z2 1. The public interest and necessity require acquisition of easements for underground and/or above ground storm drainage; 2. The proposed project, to wit: replacement, reconstruction and/or relining of storm drainage channel or drainage pipes is planned or located in the manner that will be most compatible with the greatest public good and the least private injury; 3. The property described in the Resolution is necessary for the proposed project; 4. The offer required by Section 7267.2 of the Government Code of the State of California has been made to the owner or owners of record, or the offer has not been made because the owner cannot be located with reasonable diligence.
