RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN RAFAEL
PROPOSING AMENDMENTS TO THE CHARTER OF THE CITY OF SAN RAFAEL,
AND SUBMITTING THE SAME TO THE ELECTORS OF SAID CITY
AND ORDERING THE PUBLICATION THEREOF. AND REQUESTING CONSOLIDATION,
IT IS HEREBY RESOLVED BY THE COUNCIL OF THE CITY OF SAN RAFAEL, CALIFORNIA,
AS FOLLOWS:
SECTION A. The Council of the City of San Rafael, California, on its own motion, hereby
proposes that the Charter of the City of San Rafael, California be amended by amending
Section 7 of Article VII, by adding the following as an alternate method of publication
of ordinances in accordance with the general laws of the State of California for general
law cities as set forth in Government Code Section 36933(c), REQUIREMENTS OF ORDINANCES,
to read as follows:
(6)(b) The publication of ordinances requirements of subdivision (a)
may be satisfied alternatively in accordance with the general
laws of the State of California in effect at the time the
ordinance is enacted as set forth in Government Code Section
36933(c).
SECTION B. The Council of the City of San Rafael, California on its own motion, hereby
proposes that the Charter of the City of San Rafael, California, be amended by amending
Sections 3 and 3.1 of Article XIII to read as follows:
SECTION 3 - PURCHASES AND CONTRACTS.: The City Manager or an officer
authorized by the City Manager shall purchase or contract for equipment,
materials, supplies and public works required by the City in the manner
prescribed by Ordinance.
SECTION 3.1 - BIDS AND AWARDS: The Council shall establish annually by
Ordinance at a public hearing the conditions and procedures for any purchase
or contract, and establish advertising and bidding requirements.
SECTION C. The Council of the city of San Rafael proposes to, and does on its own
motion, submit to the qualified electors of the City of San Rafael, California, at the
General Municipal Election to be held on the 2nd day of November, 1993, the proposals to
amend the Charter of the City of San Rafael, California, as set forth in Section A, and
B above.
SECTION D. The City Clerk of the City of San Rafael is hereby ordered and directed to
cause all of said amendments to be published once a week for two successive weeks no less
than 75 and not more than 89 days prior to the date of the General Municipal Election to
be held on the 2nd day of November, 1993, in the Marin Independent Journal, the official
newspaper of said City, in each edition thereof during the day of publication, said
newspaper being a newspaper of general circulation published at least six days a week in
said City of San Rafael, California.

SECTION E. The City Council of the City of San Rafael, submits to the qualified electors
of the City of San Rafael the following ballot wording:
"CITY OF SAN RAFAEL
ALTERNATE PROCEDURE FOR PUBLICATION OF ORDINANCES
Shall Section 7 of Article VII of the Charter of the City of San
Rafael be amended to add an alternate method of publication of YES
Ordinances in accordance with the general laws of the State of
California for general law cities as set forth in Government Code NO
Section 36933(c)?"
SECTION F. The City Council of the City of San Rafael, submits to the qualified electors
of the City of San Rafael the following ballot wording:
"CITY OF SAN RAFAEL
AUTHORIZING PURCHASES AND CONTRACT BIDDING REQUIREMENTS
TO BE FIXED BY ORDINANCE
Shall Sections 3 and 3.1 of Article XIII of the Charter of the
City of San Rafael be amended to provide that the City Manager, YES
or another authorized City officer, shall purchase or contract
for equipment, materials, and/or public works required by the NO
City in the manner prescribed by City Ordinance adopted annually
at a public hearing fixing bidding and advertising requirements?"
SECTION G. The City Council of the City of San Rafael has determined that rebuttals to
ballot arguments shall not be received.
SECTION H. The City Clerk is directed to submit a certified copy of this Resolution to
the Board of Supervisors of the County of Marin, requesting consolidation.
I, JEANNE M. LEONCINI, Clerk of the City of San Rafael, hereby certify that
the foregoing Resolution was duly and regularly adopted at a regular meeting of the
Council of the City of San Rafael, held on Tuesdav , the 6th day of July, 1993, by the
following vote, to wit:
