A RESOLUTION OF THE CITY COUNCIL OF
THE CITY OF SAN RAFAEL AUTHORIZING
THE FIRE CHIEF TO ENTER INTO
AN AGREEMENT WITH CLEAN BAY TO
STORE AN OIL SPILL MITIGATION CONTAINER
WHEREAS, oil and other petroleum spills in the San Francisco Bay
present imminent environmental concern to San Rafael's waterfront,
bay inlets and canalways; and
WHEREAS, immediate deployment of equipment and personnel to
mitigate and control oil and other petroleum spills is essential to
the protection of wildlife and the environment; and
WHEREAS, Clean Bay provides oil and other petroleum spill
mitigation and control resources; and
WHEREAS, the Fire Department has the expertise and knowledge to
deploy immediate response and allocate necessary resources to oil
spill and other petroleum incidents
NOW, THEREFORE, BE IT RESOLVED by the San Rafael City Council that
the following action be taken:
RESOLVED, that the San Rafael City Council authorizes the Fire
Chief to execute an Agreement, with CLEAN BAY of Concord,
California for the storage and use of an oil spill mitigation
container.
I, JEANNE M. LEONCINI, City Clerk of the City of San Rafael, hereby
certify that the foregoing resolution was duly and regularly
introduced and adopted at a regular meeting of the City Council of
said City held on the 19th day of April, 1993, by the following
vote, to wit:

AGREEMENT
The following constitutes an agreement between CLEAN BAY and The City of San
Rafael Fire Department for the use of Clean Bay supplied materials contained in Clean
Bay's 24 foot container located at Marin Rod and Gun Club.
1. The container inventory will be checked on a quarterly basis. Once a
quarter, a Clean Bay representative will contact the San Rafael Fire
Department and they will arrange to jointly confirm the container inventory.
2. When supplies are removed from the container, it will be so noted on the
inventory control log by the person removing the supplies.
3. Keys to the container will be distributed to Clean Bay and the San Rafael
Fire Department.
4. Clean Bay will replace inventory removed by/or at the direction of Clean Bay.
5. Inventory removed by others will be replaced by the using agency. If
requested, Clean Bay will replace consumed inventory and invoice San Rafael
Fire Department.
6. Disposal or cleaning of any inventory contaminated with oil will be the
responsibility of the using agency.
7. In return, for access to the container inventory, City of San Rafael agrees to
provide storage space for the container.
8. The container is to be moved only with the permission of Clean Bay.
9. In return for storage space for the container, Clean Bay agrees to provide
reasonable training to Fire Department personnel in the use and deployment
of stored inventory.
