RESOLUTION OF INTENT REGARDING THE USE
OF ISTEA FUNDS BY THE CITY OF SAN RAFAEL FOR THE
MERRYDALE OVERCROSSING/HIGHWAY 101 PROJECT
wnr,.%r.AS, the City has proposed and intends to make certain improvements to the
Merrydale Overcrossing on Highway 101 (the "Merrydale Overcrossing Project"), which
improvements are within the City of San Rafael; and
WHEREAS, the Merrydale Overcrossing Project includes the following: 1.) The
construction of a street overcrossing of the US 101 freeway from Las Gallinas Avenue to Civic
Center Drive in the vicinity of Merrydale Road; and 2.) The construction of a new northbound
onramp from Redwood Highway Road on to the US 101 freeway, approximately 0.1 miles north
of the Freitas Parkway Interchange; and
WHEREAS, the Metropolitan Transportation Commission has approved the
application of the City for $1,112,500 of Federal funds, authorized by the Federal Intermodal
Surface Transportation Act (ISTEA) to be used for the Merrydale Overcrossing Project; and
WHEREAS, the total estimated cost of the Merrydale Overcrossing Project is $ 6.9
million; and
WHEREAS, as a condition of receiving the ISTEA funds, the City is required to provide
local matching funds of 11.5% of the total project costs; and
WHEREAS, as a further condition of receiving the ISTEA funds, the City is required to
adopt a resolution making certain representations and findings.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN
RAFAEL that:
Section 1. the Merrydale Overcrossing Project shall be developed and constructed to
include the improvement s described above.
Section 2. In addition to the ISTEA funds, the City shall be responsible for providing,
out of City, State, local or private funding sources, all of the costs of developing and
constructing the Merrydale Overcrossing Project. The City agrees that it shall provide or
obtain at least 11.5% of the total costs of construction for the Merrydale Overcrossing Project
from local sources.
Section 3. The City agrees that, in accordance with the schedule provided and approved
by MTC, construction of the Merrydale Overcrossing Project shall begin in August of 1993.
Section 4. The City understands that the amount of ISTEA funds allocated to the
Merrydale Overcrossing is fixed at $1,112,500 and that no additional ISTEA funds will be
available for such project.

foregoing resolution was duly and regularly introduced and adopted at a regular meeting of the
Council of said City on Monday, the 3rd day of May, 1993, by the following vote, to wit:
