HomeMy WebLinkAboutCC Resolution 8844 (Northgate One Shopping Center)RESOLUTION NO. 8844 A RESOLUTION OF THE CITY COUNCIL OF THE CITY SAN OF RAFAEL ACCEPTING GRANT OF EASEMENT FOR CONSTRUCTION AND MAINTENANCE OF STORM DRAIN - NORTHGATE ONE SHOPPING CENTER (AP# 175-321-31) WHEREAS, the public interest, convenience, necessity and welfare require that the real property hereinafter mentioned be accepted and used for the benefit of the public of the City of San Rafael, California. NOW, THEREFORE BE IT RESOLVED that the City Council of the City of San Rafael, California, does hereby accept that certain Grant of Easement from Northgate Properties, dated August 20, 1991, for and on behalf of the City of San Rafael and the real property described therein, all as more particularly described and set forth in the attachment hereto and incorporated herein by reference, and the Clerk of said City is hereby directed to cause said deed to be duly recorded in the Office of the County Recorder of the County of Marin, State of California, forthwith upon the adoption of this resolution. Said strip of land is located in the City of San Rafael, County of Marin, State of California, and is more particularly described as follows: See Exhibit A attached Grantor shall not plant, place or deposit anything in or on said strip of land which will damage or interfere with any of the rights granted hereunder nor shall Grantor erect or construct any building or other structure or drill or operate any well within said strip of land. The provisions hereof shall inure to the benefit of and bind the heirs, successors, and assigns of the respective parties hereto. Freitas Parkway as shown on that certain map or plat entitled "Map bf Northgate Shopping Center" filed in the office of the Marin County Recorder on April 13, 1960 in Book 10 of Maps at page 56; thence along said southerly boundary South 55037'00" East 108.57 feet to the northwesterly corner of Northgate Drive as shown on that certain map or plat entitled "Map of Northgate Drive" filed in the office of the Marin County Recorder on December 3, 1962 in Book 11 of Maps at page 53; thence along the westerly boundary of said Northgate Drive along a curve concave to the southwest, tangent to the preceding course, having a radius of 30.00 feet through a central angle of 90100'00" an arc distance of 47.12 feet to a point of reverse curvature; thence along a tangent curve concave to the east having a radius of 400.00 feet through a central angle of 5021152" an arc distance of 37.45 feet to the TRUE POINT OF BEGINNING of the line hereinafter described; thence from said True Point of Beginning leaving said westerly boundary of Northgate Drive North 76°15'17" West 109.04 feet; thence North 59°45'17" West 110.00 feet; thence North 15°14'43" East 80 feet, more or less, to the southwesterly line of that certain 10 foot wide strip designated as "Drainage Easement" on said map of Northgate Shopping Center (10 Maps 56) and there terminating.
