HomeMy WebLinkAboutCC Resolution 8846 (Quail Hill Townhouses Subdivision)RESOLUTION NO. 8846 A RESOLUTION AUTHORIZING AGREEMENT BETWEEN THE CITY OF SAN RAFAEL AND QUAIL HILL TOWNHOUSES, INC. FOR RESURFACING OF PRIVATE STREETS WITHIN THE QUAIL HILL TOWNHOUSES SUBDIVISION WHEREAS, Quail Hill Townhouses, Inc. have requested that the City of San Rafael include the resurfacing of streets within Quail Hill in the City's Street Resurfacing Project for 1993; and WHEREAS, the City has no objections to their inclusion subject to the payment of a 15% overhead and administration charge and certain other conditions outlined in the Agreement. NOW, THEREFORE, BE IT RESOLVED that the City agrees to enter into an agreement with Quail Hill Townhouses, Inc. as attached hereto. IT IS FURTHER RESOLVED that the Director of Public Works be authorized to execute said Agreement. I, JEANNE. M. FOR RESURFACING OF PRIVATE STREETS WITHIN THE QUAIL HILL TOWNHOUSES THIS AGREEMENT entered into this 15th day of March , 1993, by and between the CITY OF SAN RAFAEL (CITY), and the QUAIL HILL TOWNHOUSES, INC. (QUAIL HILL) WITNESSETH: WHEREAS, the CITY is proceeding with its annual street resurfacing program for the year 1993, in the CITY of San Rafael, County of Marin, California; and WHEREAS, QUAIL HILL has requested that the CITY include the private streets within the QUAIL HILL Townhouse Subdivision in the CITY Street Resurfacing for 1993; and WHEREAS, QUAIL HILL will be paying for all the work performed within Quail Hill Townhouses, plus an additional 15% to the CITY for design and administrative services; and WHEREAS, for the mutual benefit of both parties, the CITY has agreed to include the resurfacing of the private streets within Quail Hill Townhouses in the CITY's Street Resurfacing project for 1993; NOW THEREFORE, let it be resolved that; 1. The CITY will prepare plans, specifications and bid documents for the resurfacing of private streets within Quail Hill Townhouses and other miscellaneous associated work necessary for the satisfactory completion of the project. The City will provide inspection as required during construction. The work tasks shall include: Asphalt Grinding (Cold Planing). Asphalt Resurfacing. Fabric Reinforcement. Adjust Manhole, Rodhole, Monument Casting to Grade. Roadway Striping. 2. All plans and specifications will be prepared in accordance with CITY of San Rafael Standards and in accordance with the California Standard Specification July 1992. 3. Areas of work to be resurfaced shall include: I. Faisan Drive. II. Perdiz Court. 1 COP} AGREEMENT BETWEEN THE CITY OF SAN RAFAEL AND QUAIL HILL TOWNHOUSES, INC. FOR RESURFACING OF PRIVATE STREETS WITHIN THE QUAIL HILL TOWNHOUSES III. La Alondra. IV. El Condor Court. V. All Roadside Parking Areas. VI. Club House Parking Lot. 4. The resurfacing section shall be in accordance with the requirements of QUAIL HILL. The CITY assumes no responsibility regarding the adequacy of the resurfacing design section. 5. All plans shall be reviewed, approved and signed by QUAIL HILL, prior to going out to bid. 6. The CITY will include QUAIL HILL as additional insured on the Contractors Insurance policy for Public Liability and Property damage at the same limits as the CITY. 7. QUAIL HILL shall be invited to attend the bid opening and pre -construction meeting with the Contractor. 8. All work shall be performed by the Contractor hired by the CITY to perform the work. 9. All work shall be observed and final quantities measured by the CITY. 10. QUAIL HILL shall not direct the Contractor to perform any work. All direction shall be through the CITY. 11. Any additional work that QUAIL HILL requests, that is not shown on the plans shall be directed through the CITY. The CITY shall prepare a Contract Change Order that shall be signed by QUAIL HILL prior to issuance to the Contractor. 12. All work shall be guaranteed for one year after date of completion by the Contractor. The CITY will not guarantee or be responsible for any of the work performed. All claims for deficient work must be filed with the Contractor. 13. Final payment shall be based on actual field measurements of the work performed. 14. All payments shall be made by the CITY. QUAIL HILL shall receive copies of all payments to the Contractor regarding their work. Any comments or questions shall be directed to the CITY, in writing, within ten (10) days. 2 AGREEMENT BETWEEN THE CITY OF SAN RAFAEL AND QUAIL HILL TOWNHOUSES, INC. FOR RESURFACING OF PRIVATE STREETS WITHIN THE QUAIL HILL TOWNHOUSES 15. QUAIL HILL shall be responsible for the payment of all bid items relating to the work in Quail Hill Townhouses, plus any Contract Change Orders authorized by QUAIL HILL. 16. QUAIL HILL shall pay to the CITY an amount equal to 15% of the Final Cost of the work performed in QUAIL HILL Townhouses, for the CITY's design, contract administration, observation, overhead and all other related services. 17. Upon award of Contract to the Contractor, by the CITY Council, QUAIL HILL shall deposit a check, within five (5) days, for their portion of the bid amount plus an additional 15% for design and contract administration services, plus an additional 25% for contingency expenses. 18. Upon completion of the contract and final payment, all Quail Hill contingency monies not spent on Quail Hill will be returned to QUAIL HILL within thirty-five (35) days. CI SAN RAFAEL DAVID M.
