HomeMy WebLinkAboutCC Resolution 8774 (Vacate Easement Ayala Court)RESOLUTION NO. 8774 A RESOLUTION ORDERING CLOSING, ABANDONING AND VACATING THREE FOOT WIDE PUBLIC UTILITIES EASE- MENT AFFECTING LOTS 1 AND 2, AYALA COURT SUBDIVI- SION, SAN RAFAEL, CALIFORNIA WHEREAS, the City Council of the City of San Rafael on the 5th day of October, 1992, adopted Resolution No. 8753 entitled, "Resolution of Intention to Vacate three foot wide Public Utilities Easement affecting Lots 1 and 2, Ayala Court Subdivision, San Rafael, California'; and WHEREAS, said Resolution was posted as required by law; and WHEREAS, the Department of Public Works of the City of San Rafael, Californias, conspicuously posted notices of easement vacation as required by law; and WHEREAS, a hearing was held this day as required by law and said Resolution No. 8753, at which hearing the Council of the City of San Rafael heard evidence offered by persons interested; and WHEREAS, it appears from all of the evidence submitted that the following described easement area is unnecessary for present or prospective public use; NOW, THEREFORE, IT IS HEREBY RESOLVED as follows: 1. That the following described easement area is unnecessary for present or prospective public use; 2. That the following described easement area is hereby ordered closed, abandoned and vacated; 3. That the easement area closed, abandoned and vacated is described on Exhibit "A" which is attached hereto and incorporated herein by reference. I, JEANNE. M. LEONCINI, Clerk of the City of San Rafael, hereby certify that the foregoing resolution was duly and regularly introduced and adopted at a regular meeting of the Council of said City on Monday, the 2nd day of November, 1992, by the following vote, to wit: AYES: COUNCILMEMBERS: Cohen, Shippey, Thayer & Mayor Boro NOES: COUNCLLMEMBERS: None ABSENT: COUNCILMEMBERS: Breiner Q*MNE M. TO BE VACATED An easement, three feet wide, adjacent and parallel to the westerly side of the following described line: Beginning at a point at the southeasterly corner of Lot 1, which point is also the southwesterly corner of Lot 2, as shown upon the Map entitled "Map of Ayala Court Subdivision", recorded October 24, 1963 in Volume 12 of Maps at Page 40, running thence northerly along the easterly side of Lot 1. North 7°51'28" East 104.09 feet, to a point on the northeasterly boundary of said subdivision, said point being the most northerly common corner of said Lots 1 and 2.
