RESOLUTION OF THE SAN RAFAEL CITY COUNCIL DENYING THE APPEAL OF
PLANNING COMMISSION CONDITION OF APPROVAL #14; REQUIRING THE
CONSTRUCTION OF SIDEWALKS (ED 91-55) FOR THE CONSTRUCTION OF A
NEW 1,730 SQ. FT. MULTI-PURPOSE ROOM FOR THE TRINITY LUTHERAN
CHURCH; 333 WOODLAND AVENUE
WHEREAS, on July 1, 1991, an application (ED 91-55) requesting an Environmental
and Design review permit for the construction of a new 1,730 sq. ft. multi-purpose
room was submitted to the Planning Department; and
WHEREAS, upon review of the subject application, the project was found to be
categorically exempt from the requirements of the California Environmental
Quality Act (CEQA) under Section 15303(c); and,
WHEREAS, the project was reviewed by the Design Review Board on August 20,
1991, October 8, 1991, December 17,1991. At the meeting of December 17, 1991, the
Design Review Board recommended approval of the project; and
WHEREAS, on February 11, 1992, the San Rafael Planning Commission held a duly
noticed Public Hearing on the proposed design review application for the building
addition, accepting public testimony and the written report of the Planning
department staff and continued the item; and,
WHEREAS, on February 25, 1992, the San Rafael Planning Commission held
another public hearing to consider the design review application and voted to
approve the application; and
WHEREAS, the Trinity Lutheran Church appealed Planning Commission
condition of approval #14 of the Environmental and Design Review permit in a
letter dated February 27, 1992 and the City Council heard the matter at a duly noticed
public hearing on March 16, 1992 and continued the item;
NOW, THEREFORE, BE IT RESOLVED that the San Rafael City Council hereby
denies the appeal of condition of approval #14 of Environmental and Design
Review permit ED 91-55 based on the following findings:
1. The Environmental and Design Review application conforms to the
design standards established in the General Plan 2000 and Criteria for
Approval of Applications as listed in Section 14.11.050 of the San Rafael
Zoning Ordinance.
2. Funding for the construction of the sidewalks required in Condition of
Approval #14 of the permit shall occur as follows: (1) Prior to the
issuance of a building permit, the applicant shall submit $5,000, as
adjusted by the Lee Saylor price index, to the Public Works Department
for the construction of the required sidewalks; (2) All remaining costs
incurred with the construction of the sidewalks shall be funded with the
City's gas tax fund.
