A RESOLUTION OF THE CITY COUNCIL OF
SAN RAFAEL AUTHORIZING THE EXECUTION
OF A QUIT CLAIM DEED TO THE DINO AND
MARIO GHILOTTI FAMILY TRUST
THE CITY COUNCIL OF THE CITY OF SAN RAFAEL DO HEREBY RESOLVE:
The MAYOR and CITY CLERK are authorized to execute, on behalf
of the City of San Rafael a Quit Claim Deed to PATRICK J. McNEIL,
GARY NOTTI, DIANE ONGARO and MICHAEL GHILOTTI, Trustees of THE DINO
AND MARIO GHILOTTI FAMILY TRUST (formerly known as the GHILOTTI
BROS. FAMILY TRUST), an Inter Vivos Trust created on June 29, 1984,
a copy of which is hereby attached and by this reference made a
part hereof.
I, JEANNE M. LEONCINI, Clerk of the City of San Rafael, hereby
certify that the foregoing resolution was duly and regularly
introduced and adopted at a regular meeting of the Council of said
City held on Monday, the 3rd day of August, 1992, by the following
vote, to wit:

FOR A VALUABLE CONSIDERATION, receipt of which is hereby acknowledged,
THE CITY OF SAN RAFAEL,
a municipal corporation,
do es hereby remise, release and forever quitclaim to PATRICK J. NcNEIL, GARY NOTTI, DIANE ONGARO and
MICHAEL GHILOTTI, Trustees of THE DINO AND MARIO GHILOTTI FAMILY TRUST (formerly
known as the GHILOTTI BROS. FAMILY TRUST), an Inter Vivos Trust created on
June 29, 1984
the following described real property in the City of San Rafael County of Marin,
State of California:
An easement for roadway and utility purposes, 60 feet in width, lying 30 feet
on each side of a center line which begins at the most Southerly corner of the
property described in Parcel Two in the deed from Marin Canalways & Development
Co., a corporation, to Marin Development Co., a limited partnership, recorded
March 26, 1956 in Volume 1016 of Official Records, at page 24, Marin County
Records and runs North 380 46 ' East 1250 feet.
Excepting therefrom that portion lying outside of the boundaries of Parcel One,
as described in the deed from Marin Canalways & Development Co., a corporation,
to Equitable Development Co., a limited partnership, recorded December 18, 1957
in Book 1160 of Official Records, at page 382, Marin County Records.
The purpose of this Quitclaim Deed is to relinquish any and all right, title,
estate, and interest of THE CITY OF SAN RAFAEL in and to the above-described
easement as reserved in the certain Grant Deed from Marin Canalways & Development
Co., a corporation, to EQUITABLE DEVELOPMENT CO., a limited partnership, recorded
on December 18, 1957 in Book 1160 of Official Records, at page 382, Marin County
Records.
