HomeMy WebLinkAboutCC Resolution 8757 (Risk Management Policy)RESOLUTION NO. 8757 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN RAFAEL ESTABLISHING A RISK MANAGEMENT POLICY WHEREAS, the City of San Rafael is exposed to various risks of loss resulting from occurrences involving disappearance, damage and destruction of City -owned property and property of others, injury to employees or others, dishonesty and unforeseen liabilities imposed by law or assumed by contract; and WHEREAS, the philosophy of the City is oriented toward comprehensive public and employee safety, minimization or elimination of risk to the greatest extent practicable, retention of the remaining risk when feasible, and protection against unpredictable loss by reasonable use of available insurance and/or funding when there is a significant possibility of loss in excess of the amount established as a reasonable self -retention; and WHEREAS, to accomplish this objective, it is vital that a strong risk management, safety and loss control program be adopted, which can best be implemented by a safety consciousness and awareness on the part of all management and personnel who work with the City of San Rafael; and WHEREAS, recognizing the need for a systematic and coordinated approach to the handling of risk, the City of San Rafael has established a risk management policy; and WHEREAS, it is the objective of the City of San Rafael to manage, control, minimize or eliminate risk, to the extent that its residents and personnel can reasonably be protected from hazards, and ensure that the financial solvency of the City not be jeopardized, and that the City's resources be conserved. NOW, THEREFORE, BE IT RESOLVED that the risk management policy of City of San Rafael include the following provisions: A. The appropriate principles of risk management shall be applied at every management level for the purpose of: 1. Identifying and evaluating risk; 2. Avoiding or eliminating risk when practicable; 3. Minimizing, controlling or contractually transferring risk to others where possible. ORIGINAL Yow B. Current funds shall be utilized without seriously affecting the financial position of the organization. C. The procurement of insurance, either through the California Joint Powers Risk Management Authority or independently, shall be based on the availability of coverage at a reasonable cost and subject to the practicalities applicable to the City's self-insurance program and fiscally appropriate self -retention levels. D. Upon approval of its recommendation by the City Manager, the Property and Casualty Loss Committee shall have settlement authority of liability claims up to $20,000. All liability settlement proposals in excess of $20,000 shall be referred to the City Council. The Property and Casualty Loss Committee shall also have the authority to reject liability claims. The City Manager shall have settlement authority of Workers' Compensation claims up to $20,000. I, JEANNE M.
