HomeMy WebLinkAboutCC Resolution 8335 (Recyclable Products)RESOLUTION NO. 8335 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN RAFAEL IN SUPPORT OF PROCURING RECYCLED, REUSABLE, AND RECYCLABLE PRODUCTS WHEREAS, the volume of material disposed of at Marin's landfills has been increasing annually; and WHEREAS, sanitary landfill space is at a premium and it is becoming increasingly difficult to site new landfills; and WHEREAS, much of the material that enters the waste stream can be recycled, reused, or incorporated into the manufacture of new products; and WHEREAS, City participation in and promotion of recycling programs can significantly reduce the volume of material entering the waste stream thereby extending landfill life expectancy and reducing expenses; and WHEREAS, for recycling programs to be effective, markets must be developed for products that incorporate postconsumer materials in their manufacture, are reusable, or are designed to be recycled; and WHEREAS, California State Law requires that local agencies buy recycled products if fitness, quality, and price are equal to nonrecycled products and allows local agencies to adopt purchasing preferences for recycled products; NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of San Rafael adopts the following actions: 1. The Central Services (Purchasing) Department shall continue and intensify its review of existing product specifications to determine whether they would require the uses of products manufactured from virgin materials or exclude the use of recycled, reusable, or recyclable products, and shall submit the results of its review to the City Manager or her designee. 2. In the event that current specifications exclude the use of recycled products or require the use of virgin materials, such exclusions or requirements shall be eliminated unless it can be demonstrated to the City Manager's satisfaction that these recycled products would not achieve a necessary performance standard. Future specifications shall incorporate a requirement for the use of recycled, reusable, and recyclable products to the maximum extent practicable. 3. A price preference not -to -exceed fifteen (15) percent may be given to recycled, reusable, and recyclable products. The preference percentage shall be based on the lowest bid or price quoted by the supplier or suppliers offering non -recycled products. 4. When recycled products are used, reasonable efforts shall be undertaken to label the products to indicate that they contain recycled materials. 5. The City encourages its residents and businesses to recycle and to purchase recycled, reusable and recyclable products. I, JEANNE M.
