HomeMy WebLinkAboutCC Resolution 8338 (Bret Harte Terrace Pedestrian Way)RESOLUTION NO. 8 3 3 8 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN RAFAEL ORDERING VACATION OF PEDESTRIAN WAY, BRET HARTE TERRACE UNIT TWO, SAN RAFAEL, CALIFORNIA WHEREAS, the City Council of the City of San Rafael, on the 7th day of January, 1991, passed and adopted Resolution No. 8322, entitled "RESOLUTION OF INTENTION TO ORDER VACATION OF PEDESTRIAN WAY, BRET HARTE TERRACE UNIT TWO", AND WHEREAS, notice was published and posted as required by law, and WHEREAS, a hearing was had this day as required by law, and said Resolution No. 8322, at which hearing the Council of the City of San Rafael heard evidence offered by all persons interested in or objecting to the vacation hereinafter ordered, and WHEREAS, it appears from the evidence offered and from all of the evidence submitted, and the said Council finds, that the pedestrian way herein described is unnecessary for present or prospective public pedestrian purposes. NOW, THEREFORE, IT IS HEREBY RESOLVED AND ORDERED that the pedestrian way in Bret Harte Terrace Unit Two, located in the City of San Rafael, California, hereinafter more particularly described, is unnecessary for present or prospective public pedestrian purposes and is hereby vacated. The pedestrian way proposed to be vacated is located in the City of San Rafael, State of California, and is more particularly described as follows: Being a ten foot wide pedestrian way adjacent to and along the northerly line of lot 50 as shown upon that certain map entitled "Map of Bret Harte Terrace Unit Two, San Rafael, California", recorded April 11, 1952 in Volume 7 of Maps at Page 57, Marin County Records. I, JEANNE. M. LEONCINI, Clerk of the City of San Rafael, hereby certify that the foregoing resolution was duly and regularly introduced and adopted at a regular meeting of the Council of said City on Monday, the 4th day of February, 1991 by the following vote, to wit: AYES: COUNCILMEMBERS: Boro, Breiner, Shippey, Thayer & Mayor Mulryan NOES: COUNCILMEMBERS: None ABSENT: COUNCILMEMBERS: None M.
