A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
SAN RAFAEL AUTHORIZING ENDORSEMENT OF PROJECT
MANAGEMENT PLAN FOR CORPS OF ENGINEERS' CANAL
FLOOD STUDY,AND APPROVING AND AUTHORIZING
EXECUTION OF THE THIRD AMENDMENT TO THE "COST
SHARING AGREEMENT"
WHEREAS, the City of San Rafael (hereinafter referred to as "City") has
entered into a Cost Sharing Agreement with the U.S. Army Corps of Engineers (hereinafter
referred to as "Corps") to perform a General Investigation Study (hereinafter referred to as
"Study") to identify solutions to flooding in East San Rafael adjacent to the San Rafael
Canal; and
WHEREAS, the Corps has requested that the City endorse the "Project
Management Report" for the Study; and
WHEREAS, the Corps has requested that the City approve a third
amendment to the "Cost Sharing Agreement" which estimates that an additional $400,000
will be required to complete the Study; and that the City's share of this amount will be
$200,000.
NOW, THEREFORE, BE IT RESOLVED that
1. The City Council endorses the "Project Management Report" for the
Study and hereby authorizes the Mayor and the Director of Public Works to sign said
document; and
2. City Council approves the third amendment to the "Cost Sharing
Agreement" and hereby authorizes the Mayor and the Director of Public Works to sign said
amendment.

the foregoing resolution was duly and regularly introduced and adopted at a regular
meeting of the Council of said City on Tuesday, the 19th day of February, 1991 by the

In accordance with Article III of the Agreement Between the United States
of America and the City of San Rafael for the General Investigations,
Flood Control Study, Feasibility Phase dated June 6, 1988, the Scope of
Studies for said Agreement is amended a third time as follows:
I. Phase II - PLAN SELECTION
The scheduled expenditures for the following task is revised as
indicated:
