RESOLUTION OF THE CITY OF SAN RAFAEL WAIVING FORMAL
BIDDING PROCESS AND AUTHORIZING EXPENDITURE OF UN-
APPROPRIATED RESERVES FOR THE INSTALLATION OF ALTER-
NATIVE WATER RETENTION AND DISTRIBUTION FACILITIES
WHERAS, the Marin Municipal Water District has established a water
allocation policy restricting the use of potable water at City facilities to 50% of normal use
for all City owned buildings and to 15% for all City owned parks, median islands and
landscaped areas; and
WHEREAS, these restrictions were acted upon on February 6, 1991 and will
become effective March 1, 1991; and
WHEREAS, the City must implement the installation alternative of water
retention and distribution facilities to be able to comply with the reduction policies of
MMWD; and
WHEREAS, if these measures are not implemented immediately, substantial
and severe losses to City -owned facilities will occur; and
WHEREAS, to expedite the installation of these facilities, it is necessary to
waive the formal bid procedure mandated by the charter provision.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of
San Rafael hereby determines that the public health, safety and welfare necessitates the
waiver of the San Rafael Charter provisions for competitive bidding for the installation of
alternative water retention and distribution facilities to save the City's public investments
in its parks, island, and landscaped areas, and directs City staff to proceed with said work
with all possible dispatch.
BE IT FURTHER RESOLVED that said Council hereby authorizes the
expenditure of unappropriated reserves for said work.

the foregoing resolution was duly and regularly introduced and adopted at a regular
meeting of the Council of said City on Tuesday, the 19th day of February, 1991 by the
following vote, to wit:
