HomeMy WebLinkAboutCC Resolution 8355 (Broderbund Software)RESOLUTION NO. 8355 RESOLUTION OF THE SAN RAFAEL CITY COUNCIL CERTIFYING A NEGATIVE DECLARATION AND ADOPTION OF A ZONE CHANGE FROM PCM -NG (I-33) (PLANNED COMMERCIAL AND LIGHT INDUSTRIAL DISTRICT - NORTHGATE ACTIVITY CENTER OVERLAY DISTRICT (INDUSTRIAL - 33 PEAK PM TRIPS) TO PCM -NG (PLANNED COMMERCIAL AND LIGHT INDUSTRIAL DISTRICT - NORTHGATE ACTIVITY CENTER OVERLAY DISTRICT); 4300 REDWOOD HIGHWAY; AP #155-110-06. (BRODERBUND SOFTWARE) WHEREAS, the San Rafael Planning Department has received zone change, use permit, design review and lot line adjustment applications for the remodel of an existing 113,000 sq. ft. industrial/ office building and for the construction of a new 21,5000 sq. ft. conference center; and, WHEREAS, an environmental initial study was prepared, consistent with the California Environmental Quality Act; and, WHEREAS, it was concluded in the initial study that the proposed zone change did not have the potential for creating a significant impact on the environment; and, WHEREAS, a Negative Declaration has ben prepared determining that no significant environmental impacts will result from this project; and, WHEREAS, on February 26, 1991, the Planning Commission approved Design Review, lot line adjustment and use permit applications and recommended that the City Council certify the Negative Declaration and approve the rezoning application; NOW, THEREFORE BE IT FURTHER RESOLVED that the City Council certify the Negative Declaration and adopt the zone change on parcel #155-110-06 from PCM -NG (I-33) to PCM -NG, based on the following findings: 1) The proposed zone change would be consistent with the San Rafael General Plan in that the proposed rezoning of Assessor's Parcel #155- 110-06 from PCM -NG (I-33) to PCM -NG would be consistent with the assigned PM peak trip allocation for the subject parcel, as stated in the General Plan 2000 (Appendix B). 2) The proposed zone change would not be detrimental to the health, safety or general welfare of the surrounding community or the City of San Rafael as a whole. The impacts of development consistent with the General Plan trip allocations have been assessed through the General Plan Environmental Impact Report. Circulation system improvements identified as mitigation measures by this environmental document have been required as conditions of approval of a use permit for the development of the subject property.
