A RESOLUTION AUTHORIZING THE SIGNING OF
A LICENSE AGREEMENT FOR #5 PLEASANT LANE
THE CITY COUNCIL OF THE CITY OF SAN RAFAEL RESOLVES
AS FOLLOWS:
The Director of Public Works and the City Clerk are hereby
authorized to execute, on behalf of the City of San Rafael, a license
agreement with the owners of #5 Pleasant Lane (AP# 12-235-01) to
permit a right of way encroachment. A copy of said license agreement
is hereby attached and by this reference made a part of this resolution.
I, JEANNE M. LEONCINI, Clerk of the City of San Rafael,
hereby certify that the foregoing resolution was duly and regularly
introduced and adopted at a regular meeting of the City Council held
on Monday, the 15th day of April, 1991, by the following vote, to wit:

LICENSE AGREEMENT
FOR ENCROACHMENT AT #5 PLEASANT LANE
This Agreement made this 15th day of April, 1991, by and between the City
of San Rafael, County of Marin, State of California hereinafter referred to as
"Licensor", and William T. George, hereinafter referred to as "Licensee".
PREAMBLE C
WHEREAS, Licensor is the owner of that certain street right of way known as
Pleasant Lane in the City of San Rafael, County of Marin, State of California,
shown on Exhibit 'A' attached and incorporated herein by reference; and
WHEREAS, Licensee is the owner of the residence located at 5 Pleasant Lane,
i San Rafael, and known as Marin County Assessor's Parcel No. 12-235-01,
Y more particularly described in Exhibit 'B' attached and incorporated herein
by reference; and

WHEREAS, a portion of said residential structure encroaches 50 square feet,
more or less, upon Licensor's property described in Exhibit 'A'; and

W WHEREAS, Licensee desires to obtain formal permission to continue to
s occupy Licensor's property.
z NOW, THEREFORE, it is agreed as follows:

o Q' GRANT OF A LICENSE
1. Licensor grants Licensee permission to make limited use of the street
J right of way known as Pleasant Lane as shown on Exhibit 'A' for the
z Q following purpose only:
a For the support of that portion of Licensee's residential structure which
encroaches upon Licensor's real property as described in Exhibit 'B'.
Comprising of 50 square feet, more or less.
N 2. This license shall become effective immediately and continue indefi-
nitely but may be terminated by either party with thirty (30) days

3. Licensee shall not assign this license or any interest therein or allow any
0 0 other person to occupy or use the premises, or any portion thereof
= without the prior written consent of Licensor.
0 4. This Agreement does not constitute a lease, but constitutes a mere li-
Uj W a cense to Licensee. Licensee shall have no right or privilege in any
LU ^ respect whatsoever to use any other part of the property Licensor for any
