HomeMy WebLinkAboutCC Resolution 8397 (Smith Ranch Road)RESOLUTION NO. 8 3 9 7 A RESOLUTION OF THE CITY COUNCIL OF SAN RAFAEL, CERTIFYING A NEGATIVE DECLARATION FOR AMENDMENT OF THE ZONING MAP OF THE CITY OF SAN RAFAEL ADOPTED BY REFERENCE BY SECTION 14.15.020 OF THE MUNICIPAL CODE OF SAN RAFAEL, CALIFORNIA, SO AS TO RECLASSIFY CERTAIN REAL PROPERTY IN THE NORTHGATE ACTIVITY CENTER (RE Z91-2 - 101 & 111 SMITH RANCH ROAD) WHEREAS, on March 19, 1991, an application requesting the above referenced zone change was found by the Planning Department to be complete for processing; and, WHEREAS, upon review of the subject application in accordance with the requirements of the California Environmental Quality Act (CEQA), an Initial Study was completed by Planning staff; and, WHEREAS, it was concluded in the Initial Study that the proposed zone change did not have the potential for creating a significant impact on the environment; and, WHEREAS, on May 6, 1991, the San Rafael City Council held a duly noticed Public Hearing on the proposed zone change application, accepting public testimony and the written report of the Planning Department staff; and, WHEREAS, the City Council determined that the project was consistent with the General Plan in that the requested zone change would allocate 71 peak p.m. trips to Parcel 3A, 60 peak p.m. trips to Parcel 3B, and 8 peak p.m. trips to Parcel 3C, the sum of which is equal to the 139 peak p.m. trips generated by the approved retail, office, fire station site project and less that the 152 peak p.m. trips assigned to the site by the General Plan; and, WHEREAS, the City Council determined that the proposed zone change did not have the potential for creating a significant impact on the environment and therefore Certified a Negative Declaration in accordance with the California Environmental Quality Act. NOW, THEREFORE, BE IT RESOLVED, that the San Rafael City Council finds there is no substantial evidence in the record showing that the project could have a significant effect on the environment and certifies the Negative Declaration for Zone Change application Z91-2. I, JEANNE M.
