HomeMy WebLinkAboutCC Resolution 8410 (Merrydale Overcrossing)RESOLUTION NO. 8 410 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN RAFAEL SETTING FORTH THE INTENTION OF THE CITY COUNCIL TO ADOPT RESOLUTIONS OF NECESSITY FOR ACQUISITION OF PROPERTY FOR TIE MERRYDALE OVERCROSSING PROJECT WHEREAS, under the Eminent Domain Law, before the City may file an action to acquire property by exercise of the power of eminent domain, the City Council must adopt a resolution of necessity. Prior to adoption of such a resolution, it is necessary for the City to provide those persons whose property would be subject to acquisition pursuant to such resolution with a reasonable opportunity to appear and be heard on the matters referred to in Code of Civil Procedure Section 1240.030 and notice of the intent of the City Council to adopt such resolution. WHEREAS, the City Council desires to set a date for consideration of a resolution of necessity in connection with property acquisition for the Merrydale Overcrossing project and express its intent to adopt such a resolution. NOW, THEREFORE BE IT RESOLVED as follows: Section 1. It is the intent of the City Council to adopt a resolution of necessity authorizing acquisition of property in connection with the Merrydale Overcrossing project by exercise of the City's power of eminent domain at the meeting of the City Council to be held on June 17, 1991. The property that may be subject to such resolution is described in the attached Exhibit A"'. Section 2. The City Manager or her designee is authorized to provide the notice required pursuant to Code of Civil Procedure Section 1245.235 of the City Council meeting at which the aforementioned resolution of necessity will be considered to those persons to whom notice is required to be given pursuant to Code of Civil Procedure Section 1245.235.
