HomeMy WebLinkAboutCC Resolution 8416 (912 Lincoln Ave Appeal)RESOLUTION NO. 8416 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN RAFAEL (IN ITS CAPACITY AS THE BOARD OF APPEALS) GRANTING APPEAL FROM STATE ACCESS REQUIREMENTS - 912 LINCOLN AVENUE (LAS CAMELLIAS RESTAURANT) WHEREAS, the City Council of the City of San Rafael, may serve as the Board of Appeals pursuant Health and Safety Code Section 19957.5 to hear appeals from State mandated access requirements of said Code and of the Government Code; and WHEREAS, the applicant for 912 Lincoln Avenue has appealed said access requirements before the City Council, acting as the Board of Appeals; and WHEREAS, following a noticed hearing in which said applicant was given full opportunity to be heard, the City Council, acting as the Board of Appeals, does hereby find as follows: 1. That a ramp at the main Lincoln Avenue entrance would involve over 50% of the floor space to be added. 2. That the installation of said ramp would cause a reduction of the existing number of seats. 3. That the existing porch is constructed of unreinforced masonry and must be demolished. 4. That an existing access ramp is provided to the northerly building entry and will be improved to meet correct access regulations. NOW, THEREFORE BE IT RESOLVED BY THE SAN RAFAEL CITY COUNCIL, ACTING IN ITS CAPACITY AS BOARD OF APPEALS, that in view of the foregoing findings, the appeal for relief from access requirements for 912 Lincoln Avenue, be and is hereby granted. I, JEANNE. M.
