A RESOLUTION OF THE CITY COUNCIL OF SAN RAFAEL, WAIVING THE
TRAFFIC MITIGATION FEES FOR 39 TRIPS GENERATED BY THE
EXTENDED CHILD PROGRAM AND CERTIFYING A NEGATIVE
DECLARATION FOR AMENDMENT OF THE ZONING MAP OF THE CITY
OF SAN RAFAEL ADOPTED BY REFERENCE BY SECTION 14.15.020 OF THE
MUNICIPAL CODE OF SAN RAFAEL, CALIFORNIA, SO AS TO
RECLASSIFY CERTAIN REAL PROPERTY IN THE NORTHGATE EAST
AREA
(RE: Z91-3 - 39 TRELLIS DRIVE - RELOCATION OF ST. MARK'S
SCHOOL TO THE DIXIE SCHOOL DISTRICT'S DON TIMOTEO SCHOOL
SITE, AP 175-060-01)
WHEREAS, on April 24, 1991, an application requesting the above
referenced zone change was found by the Planning Department to be
complete for processing; and,
WHEREAS, upon review of the subject application in accordance with
the requirements of the California Environmental Quality Act (CEQA), an
Initial Study was completed by Planning staff; and,
WHEREAS, it was concluded in the Initial Study that the proposed
zone change did not have the potential for creating a significant impact on
the environment; and,
WHEREAS, on June 17, 1991, the San Rafael City Council held a duly
noticed Public Hearing on the proposed zone change application, accepting
public testimony and the written report of the Planning Department staff;
and,
WHEREAS, the City Council determined that the project was
consistent with the General Plan land use designation of Low Density
Residential 2.0-6.5 units per acre/Closed School site as the policies of the
General Plan allow educational uses at this site, and with the goals and
policies of the General Plan 2000, including Master Plan for development,
child care, closed schools, circulation and trips, and the use of playing fields;
and,
WHEREAS, the City Council determined that the proposed zone
change did not have the potential for creating a significant impact on the
environment and therefore Certified a Negative Declaration in accordance
with the California Environmental Quality Act; and,
WHEREAS, the City Council determined that a waiver from Traffic
Mitigation Fees is granted for the trips generated by the extended child care on
the site as allowed by General Plan Policy LU -57 to encourage this type of use.
NOW, THEREFORE, BE IT RESOLVED, that the San Rafael City
Council finds there is no substantial evidence in the record showing that the
project could have a significant effect on the environment and certifies the
Negative Declaration for Zone Change application Z91-3; and,
BE IT FURTHER RESOLVED, that the San Rafael City Council waive
the traffic mitigation fees for 39 peak PM trips generated by the extended child
care program.

the foregoing Resolution was duly and regularly introduced and adopted at a
regular meeting of the Council of said City on Monday , the 17th day of

P -D Zoning Development Standards
(a) This P -D zoning is approved for development of the following:
Land Uses: Independent Elementary School for grades kindergarten
through eighth with a maximum of 380 students, associated before and
after school uses including extended day care, sporting activities and
evening programs; the use of the existing facilities, four additional
portable classroom units, and a Multi-purpose building.
PM Peak Trips: 146 PM Peak Trips allocated to the site (96 historic trips,
50 trips for new development)
Parking: 92 existing; a minimum of 130 to be provided upon
construction of a Multi -Purpose building
Building Setbacks: as specified on the site plan, Attachment "1"
Building_ Heig_ ht: Portable classrooms - 15'
Multi-purpose Building - 30' maximum
(b) All conditions of UP91-13 and ED91-22 shall apply
(c) This P -D zoning shall be valid for two years, or until June 17, 1993, and
shall become null and void unless a time extension is granted or a
building permit is issued.
