A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
SAN RAFAEL FINDING THAT THE PUBLIC INTEREST AND
NECESSITY REQUIRE THE ACQUISITION OF PROPERTY BY
EXERCISE OF THE CITY'S POWER OF EMINENT DOMAIN
FOR THE MERRYDALE OVERCROSSING PROJECT AND
AUTHORIZING THE FILING OF EMINENT DOMAIN ACTIONS
AND RELATED ACTIONS IN CONNECTION THEREWITH
WHEREAS, the City is authorized to acquire property for public street and
road purposes pursuant to Government Code Sections 37350.5 and 40404; and
WHEREAS, the City is undertaking the Merrydale Overcrossing Project (the
"Project") which involves construction of a new public road crossing over Highway 101
and connecting Las Gallinas Road and Civic Center Drive in the Northgate section of San
Rafael, and related curb, gutter, sidewalk and utility construction and relocation in order
to improve traffic conditions in the Northgate area; and
WHEREAS, in order to undertake the Project it is necessary for the City to
acquire certain property or interests therein that are currently privately owned and are
described in more detail in the attached Exhibit A. Said property is referred to herein as
the "Property"; and
WHEREAS, the City staff has presented a staff report in connection with
consideration of this resolution outlining the background of the Project and the need for
the Project and setting forth the fact that offers were made pursuant to Government Code
Section 7267.2; and
WHEREAS, after providing notice in the manner specified in Code of Civil
Procedure Section 1245.235, the City Council held a hearing at which those persons
whose property is to be acquired pursuant to this resolution and whose name and address
appear on the last equalized County assessment roll had an opportunity to appear and be
heard on the matters referred to in Section 1240.030.
WHEREAS, the Project has previously been the subject of environmental
review in the Northgate Activities Plan Environmental Impact Report, the General Plan
Environmental Impact Report, a negative declaration issued by the California Department
of Transportation and a finding of no significant impact issued by the Federal Highway
Administration, and, since the issuance of that negative declaration, there has been no
change in the Project or new information which indicate that it is now necessary to
prepare a new environmental impact report or subsequent or supplemental
environmental impact report; and

WHEREAS, the Planning Commission has found that the Project and the
acquisition of land therefore conforms to the General Plan.
NOW, THEREFORE BE IT RESOLVED as follows:
Section 1. The City Council hereby finds that
(a) The public interest and necessity require that the Project in that the Project
is called for in the General Plan and will mitigate traffic conditions in the
Northgate area of San Rafael to the benefit of existing and future residents and
business in the area.
(b) The Project is planned and located in the manner that will be most
compatible with the greatest public good and least private injury in that the City
has studied a number of alternative solutions to the traffic problems in this area
including freeway crossings at other locations and concluded, as set forth in the
General Plan, that the Project should be constructed as a means of mitigating traffic
problems in the area and in that the Project, because of its location largely in the
location of existing public and private vehicular rights-of-way, is designed to
minimize acquisition of or interference with private property.
(c) The Property is necessary for the Project in that if the Property were not
acquired, it would not be possible to carry out and construct the Project in the
manner presently planned.
(d) The offers required by Government Code Section 7267.2 have been made to
the owners of record of the Property.
Section 2. Eminent domain counsel for the City is authorized and directed to file
actions on behalf of the City to acquire the Property by exercise of the power of eminent
domain and take all steps necessary to prosecute those actions to completion.
Section 3. The Public Works Director and the Finance Director or their respective
designees are authorized and directed to provide from the proper funds and accounts of
the City the funds necessary to make deposits of the probable amounts of compensation in
the actions filed to acquire the Property.
