RESOLUTION OF INTENTION TO VACATE PORTION
OF OPEN SPACE EASEMENT, LOT 25, MAP OF PEACOCK
ESTATES, SAN RAFAEL, CALIFORNIA
WHEREAS, it appears that the easement hereinafter described is unnecessary for
present or prospective public use;
NOW, THEREFORE, BE IT RESOLVED AS FOLLOWS:
1. That the City Council of the City of San Rafael hereby elects to proceed under
the PUBLIC SERVICE EASEMENTS VACATION LAW of the State of California;
2. That the City Council of the City of San Rafael hereby declares its intention to
close, vacate and abandon the easement hereinafter described;
3. That Monday, the 21st day of October, 1991, at 8:00 o'clock P.M., in the Council
Chambers, City Hall, San Rafael, California, is hereby set as the time and place for hearing all
persons interested in the proposed closing, abandoning and vacation of said easement;
4. That the Department of Public Works of the City of San Rafael shall post
conspicuously notices of easement vacation along the lines of said easement proposed to be closed,
abandoned and vacated, which notices shall be posted not more than three hundred (300) feet apart
but at least three (3) notices shall be posted as to each such easement proposed to be closed,
abandoned and vacated. The said notice shall state the time and place of the hearing as
hereinabove provided, and the adoption of the within Resolution of Intention.
5. That said easement proposed to be closed, abandoned and vacated is described
on Exhibit "A", which is attached hereto and incorporated herein by reference;
6. That a map or plan showing said easement proposed to be closed, abandoned
and vacated is on file in the office of the City Clerk of the City of San Rafael at the City Hall, San
Rafael, California.
I, JEANNE. M. LEONCI NI, Clerk of the City of San Rafael, hereby certify that the
foregoing resolution was duly and regularly introduced and adopted at a regular meeting of the
Council of said City on Monday, the 16th day of September, 1991, by the following vote, to wit:
AYES: COUNCILMEMBERS: Boro, Shippey, Thayer & Vice Mayor Breiner
NOES: COUNCILMEMBERS: None
ABSENT: COUNCILMEMBERS: Mayor Mulryan

ALL THAT CERTAIN REAL PROPERTY SITUATE IN THE CITY OF SAN RAFAEL,
COUNTY OF MARIN, STATE OF CALIFORNIA, MORE PARTICULARLY DESCRIBED AS
FOLLOWS:
BEGINNING AT THE INTERSECTION OF THE TWO COURSES N 87045'00" W,
260.00 FEET AND N 02°15'00" E, 150.00 FEET, SAID INTERSECTION BEING THE
NORTHWESTERLY CORNER OF LOT 25 AS SAID LOT IS SHOWN AND DEPICTED
UPON THAT CERTAIN MAP ENTITLED "MAP OF PEACOCK ESTATES (COUNTRY
CLUB ESTATES), A SUBDIVISION OF LOT 1 (20 P.M. 10)", FILED FOR RECORD
DECEMBER 11, 1987 IN BOOK 20 OF MAPS AT PAGE 28, MARIN COUNTY RECORDS,
