A RESOLUTION ORDERING CLOSING, ABANDONING AND
VACATING PORTION OF OPEN SPACE EASEMENT, LOT 25,
MAP OF PEACOCK ESTATES, SAN RAFAEL, CALIFORNIA
WHEREAS, the City Council of the City of San Rafael on the 16th day of
September, 1991, adopted Resolution No. 8519 entitled, "Resolution of Intention
to Vacate Portion of Open Space Easement, Lot 25, Map of Peacock Estates, San
Rafael, California"; and
WHEREAS, said Resolution was posted as required by law; and
WHEREAS, the Department of Public Works of the City of San Rafael,
Californias, conspicuously posted notices of easement vacation as required by law;
and
WHEREAS, a hearing was had this day as required by law and said
Resolution No. 8519, at which hearing the Council of the City of San Rafael heard
evidence offered by persons interested; and
WHEREAS, it appears from all of the evidence submitted that the
following described easement area is unnecessary for present or prospective
public use;
NOW, THEREFORE, IT IS HEREBY RESOLVED as follows:
1. That the following described easement area is unnecessary for
present or prospective public use;
2. That the following described easement area is hereby ordered
closed, abandoned and vacated;
3. That the easement area closed, abandoned and vacated is described
on Exhibit "A" which is attached hereto and incorporated herein by reference.

certify that the foregoing resolution was duly and regularly introduced and
adopted at a regular meeting of the Council of said City on Monday, the 21st day of
October, 1991, by the following vote, to wit:

COUNTY OF MARIN, STATE OF CALIFORNIA, MORE PARTICULARLY DESCRIBED AS
FOLLOWS:
BEGINNING AT THE INTERSECTION OF THE TWO COURSES N 87045'00" W,
260.00 FEET AND N 02015'00" E, 150.00 FEET, SAID INTERSECTION BEING THE
NORTHWESTERLY CORNER OF LOT 25 AS SAID LOT IS SHOWN AND DEPICTED
UPON THAT CERTAIN MAP ENTITLED "MAP OF PEACOCK ESTATES (COUNTRY
CLUB ESTATES), A SUBDIVISION OF LOT 1 (20 P.M. 10)", FILED FOR RECORD
DECEMBER 11, 1987 IN BOOK 20 OF MAPS AT PAGE 28, MARIN COUNTY RECORDS,
THENCE ALONG THE NORTHERLY LINE OF SAID LOT 25 UPON SAID MAP S
87045'00" E, 260.00 FEET TO THE NORTHEASTERLY CORNER OF SAID LOT 25;
