HomeMy WebLinkAboutCC Resolution 8565 (Peacock Estates HOA Easement)RESOLUTION NO. 8565 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN RAFAEL ACCEPTING GRANT OF OPEN SPACE EASEMENT- PEACOCK ESTATES HOMEOWNERS ASSOCIATION WHEREAS, public interest, convenience and welfare require that the easements hereinafter mentioned be accepted and used for the benefit of the public of the City of San Rafael, California. NOW, THEREFORE, IT IS HEREBY RESOLVED by the City Council of the City of San Rafael, California, that that certain grant of easement for open space, executed by Peacock Estates Homeowners Association to the City of San Rafael, dated August 24, 1991, attached hereto and incorporated herein by reference, be and the same is hereby accepted and the Clerk of said City is hereby directed to cause said conveyance to be duly recorded in the office of the County Recorder of the County of Marin, State of California, forthwith upon the adoption of this Resolution. City Clerk 'U R 11 C, IN, A I *8�65 GRANT OF EASEMENT FOR OPEN SPACE Peacock Estates Homeowners Association (hereinafter called "Grantor" without regard to number or gender) for an adequate consideration hereby GRANTS and conveys to the CITY OF SAN RAFAEL, a municipal corporation, an EASEMENT over the strip of land hereinafter described for open space purposes, with the right of ingress thereto and egress therefrom, in, on and across said strip of land and the contiguous real property of the grantor. Said strip of land is located in the City of San Rafael, County of Marin, State of California and is more particularly described as follows: BEGINNING AT THE INTERSECTION OF THE TWO COURSES N87°45'00"W, 260.00 FEET AND NO2°15'00"E, 150.00 FEET, SAID INTERSECTION BEING THE NORTHWESTERLY CORNER OF LOT 25 AS SAID LOT IS SHOWN AND DEPICTED UPON THAT CERTAIN MAP ENTITLED "MAP OF PEACOCK ESTATES(COUNTRY CLUB ESTATES), A SUBDIVISION OF LOT 1 (20 P.M.10)", FILED FOR RECORD DECEMBER 11, 1987 IN BOOK 20 OF MAPS AT PAGE 28, MARIN COUNTY RECORDS, THENCE ALONG THE WESTERLY LINE OF SAID LOT 25 AS SHOWN UPON SAID MAP S 02015'00"W, 16.00 FEET TO THE TRUE POINT OF BEGINNING; FROM TRUE POINT OF BEGINNING THENCE CONTINUE ALONG SAID WESTERLY LINE S 02015'00"W, 134 FEET TO THE SOUTHWESTERLY CORNER OF SAID LOT 25; THENCE S 87045'00"E, 170 FEET ALONG THE SOUTHWESTERLY LINE OF SAID LOT 25 TO THE ANGLE POINT OF SAID LOT 25, SAID ANGLE POINT SITUATED UPON THE SOUTHERLY LIMIT OF A PRIVATE STORM DRAIN EASEMENT AS SHOWN AND DEPICTED UPON SAID MAP; THENCE ALONG THE SOUTHERLY LIMIT OF SAID STORM DRAIN EASEMENT N49°30'13" W, 216.46 FEET, TO THE TRUE POINT OF BEGINNING, CONTAINING 11,390 SQUARE FEET, MORE OR LESS. Grantor shall not plant, place or deposit anything in or on said strip of land which will damage or interfere with any of the rights granted hereunder nor shall Grantor erect or construct any building or other structure or drill or operate any well within said strip of land. The provisions hereof shall inure to the benefit of and bind heirs, successors, and assigns of the respective parties hereto.
