RESOLUTION AUTHORIZING THE DESTRUCTION OF CERTAIN
POLICE DEPARTMENT DOCUMENTS
WHEREAS, the Police Department has limited storage
space; and
WHEREAS, the Police Department maintains personnel
records for ex-employees for a period of at least (5) years,
as required by California Penal Code Section 832.5(b); and,
WHEREAS, Government Code Section 34090, with
limited exceptions authorizes the department head, with the
approval of the Legislative Body, by Resolution, and the
written consent of the City Attorney, to destroy any City
record, document, instrument, book, or paper under his
charge without making a copy thereof if the same is no
longer required and more than two years old.
NOW, THEREFORE, BE IT RESOLVED that the Police
Chief if authorized to destroy personnel records of those
ex-employees employed before the end of 1987 upon the
written consent of the City Attorney.
I, JEANNE M. LEONCINI, City Clerk of the City of
San Rafael do hereby certify that the foregoing Resolution
was duly and regularly introduced and adopted at a regular
meeting of the City Council of said City held on Monday, the
2nd day of December 1991, by the following vote, to wit:
AYES: Councilmembers: Breiner, Cohen, Shippey, Thayer &
Mavor Boro
NOES: Councilmembers: None
ABSENT: Councilmembers: None
