HomeMy WebLinkAboutCC Resolution 8230 (Relighting Parking Structures)RESOLUTION NO. 8230 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN RAFAEL ACCEPTING PROPOSAL FROM INDUSTRIAL POWER TECHNOLOGY FOR ELECTRICAL DESIGN SERVICES FOR RE- LIGHTING CITY PARKING STRUCTURES AT THIRD AND LOOTENS AND FIFTH AND "C" STREETS IN THE AMOUNT OF $8,575 WHEREAS, the parking structures located at Third and Lootens and Fifth and "C" Streets were constructed in 1964, and; WHEREAS, the lighting levels to the lower floor of both parking structures have deteriorated to below present Illuminating Engineers Society (I.E.S.) standards; and WHEREAS, in the interest of improving lighting levels and public safety, it is proposed to improve the lighting levels so as to meet or exceed present I.E.S. standards; and WHEREAS, Industrial Power Technology (I.P.T.) have prepared a proposal for the electrical design services for this project in the amount of $8,575.00. NOW, THEREFORE, BE IT RESOLVED that the Director of Public Works is authorized to accept, on behalf of the City of San Rafael, the proposal from Industrial Power Technology for subject project, a copy of which is attached hereto, marked Attachment "A", and incorporated herein by this reference. BE IT FURTHER RESOLVED that the Director of Public Works be and hereby is authorized to take any and all such actions as may be necessary to accomplish the purposes of this Resolution. I, JEANNE. M. We are pleased to submit our proposal for electrical engineering and design services to relight the lower covered levels of 2 existing parking garages located at Fifth Avenue and "C" Street and Third Street and Lootens Place. Design of new lighting for the stairways leading to the upper levels is included. Our Scope of Work will consist of the following services: 1. Nighttime investigation and recording of existing illumination levels. 2. Investigation of existing panelboards and control equipment to determine how much of this equipment should be reused or replaced. 3. Design of new lighting for parking areas and stairways attached to them. New illumination levels will meet or exceed the recommendations of the Illuminating Engineers Society. City of San Rafael will furnish IPT with architecturally correct mylars to be used for the design work. 4. Design of new circuits and controls, as necessary, to accomplish the lighting programs desired by the City for these garages. 5. Participate in a design coordination meeting and a pre -construction meeting with the City. 6. Prepare an opinion of probable construction cost. 7. Prepare as -built reproducible drawings using information recorded by the installing contractor. Our fee to provide these services is $8,575. This fee is itemized as follows: A. Field investigations $ 480 B. Design work 5,380 C. Conferences in San Rafael 465 D. Prepare opinion of probable cost 550 E. Construction administration 700 F. Prepare as -built drawings 1.000 Total Our fee does not include: $8,575 Design of new lighting for any areas other than the lower covered levels and stairways leading to the upper levels. 2. Work other than that listed in Items 1 through 8 in the Scope of Work. 3. Direct project expenses (refer to attached Schedule of Charges.) 4. Administration of the bidding process. 5. Assembly of the specifications and bid documents. We understand that the City of San Rafael will handle these items. Terms and Conditions: We will submit monthly progress billings in accordance with the Attached Schedule of Charges, which is an integral part of this proposal. Our fee and time schedule is based on the timely receipt of required design information. In order to recover losses sustained by IPT for prolonged delays in design progress, a project restart fee equal to 10 percent of the amount earned prior to the delay of design progress for 30 days or more will be added to IPT's invoice for each occurrence after starting the project and when such delays are caused by anyone other than IPT. Exception: Delays in design review attributed to state agencies. All reports, plans, specifications, field data, field rates, laboratory test data, calculations, cost opinions, and other documents prepared by IPT as instruments of service shall remain the property of IPT. IPT shall retain these records for a period of five (5) years following submission of IPT's report, during which period they will be made available to the Client at all reasonable times. Andrew Preston August 7, 1990 Page 3 Client agrees to limit IPT's professional liability to the lessor of the net fee received by IPT, not including reimbursable expenses and subconsultants, for all services rendered on the project, or the sum of $50,000. Client may, at its option, increase the maximum amount for which IPT shall be liable by payment of an additional fee. For the maximum liability sum of one hundred thousand dollars, the additional amount to be paid shall be two percent of the total IPT fees charged hereunder; for the maximum liability sum of two hundred fifty thousand dollars, the additional amount to be paid shall be four percent; and for the additional maximum liability sum of five hundred thousand dollars, the additional amount to be paid shall be seven percent of the total IPT fees charged hereunder. IPT is not a construction cost estimator or construction contractor, nor should IPT's rendering an opinion of probable construction costs be considered equivalent to the nature and extent of service a construction contractor would provide. IPT's opinion will be based solely upon its own experience with construction. This requires IPT to make a number of assumptions as to actual conditions that will be encountered on site; the specific decisions of other design professionals engaged; the means and methods of construction the contractor will employ; the cost and extent of labor, equipment, and materials the contractor will employ; contractor's techniques in determining prices and market conditions at the time, and other factors over which IPT has no control. Given the assumptions which must be made, IPT cannot guarantee the accuracy of its opinions of cost, and --in recognition of that fact -- the client waives any claim against IPT relative to the accuracy of IPT's opinion of probable construction cost. This proposal is valid only if accepted by September 1, 1990, unless extended by IPT. These costs include labor, special printing, telephone, courier service, photo processing, reproductions, travel by common carrier, subsistence, etc. Costs for outside consultants will be billed at cost plus 25 percent. TERMS Invoices are due and payable within fifteen (15) calendar days of the invoice date Failure to pay within forty-five (45) days from date of invoice shall grant IPT the right to refuse to render further services and such acts shall not be deemed a breach of this agreement. In the event of legal action to enforce any of the obligations of the client under this agreement, IPT shall be entitled to court costs and reasonable attorney's fees. All invoices not paid promptly will be subject to an additional administrative fee for one and one-half (1.5) percent per month.
