HomeMy WebLinkAboutCC Resolution 8235 (Diabled Learning Center)RESOLUTION NO. 8235 RESOLUTION OF THE CITY COUNCIL CERTIFYING A NEGATIVE DECLARATION AND APPROVING THE ZONE CHANGE FROM PD -NG (C-172) TO PD -NG (C-172) TO ACCOMMODATE A DEVELOPMENTALLY DISABLED LEARNING CENTER LOCATED AT 3833 REDWOOD HIGHWAY WHEREAS, a zone change application, Z90-2, was submitted to accommodate a Developmentally Disabled Learning Center; and WHEREAS, a Negative Declaration has been prepared in accordance with the provisions of the California Environmental Quality Act; and WHEREAS, a neighborhood meeting was held on July 12,1990; and WHEREAS, the San Rafael Planning Commission held a duly noticed public hearing on August 14, 1990; and WHEREAS, the Planning Commission considered all reports, letters, recommendations and testimony. NOW, THEREFORE, BE IT RESOLVED, that the San Rafael City Council, hereby certifies the Negative Declaration and approves the zone change as per conditions attached in Exhibit A and based upon the following findings: Negative Declaration 1. There is no substantial evidence that the proposed project has the potential for creating significant environmental impacts. Potential traffic impacts are mitigated by limiting the number of employees, clients, and the generation of 7 p. m. peak hour trips. Adequate on-site parking is available. 2. In the absence of substantial evidence that the use of this property for a Developmentally Disabled Learning Center has the potential to create significant environmental impacts, approval of a Negative Declaration is warranted. Z90-2 1. The proposed zone change for the property is consistent with San Rafael General Plan 2000. The use is consistent with the General Plan land use designation of General Commercial and intensity of development allowed in the Northgate Activity Center. 2. The proposed zone change would not be detrimental to the health, safety, or general welfare of the surrounding community or the City of San Rafael as a whole in that the Disabled Learning Center is the only use that is permitted and it is subject to discretionary approval. LEONC ,City Clerk EXHIBIT "A" Conditions which were included as part of the zoning (Z90-2) action by the Planning Commission on August 14,1990. (a) The site is approved for 18,000 gross square feet for use as a learning center for training developmentally disabled adults, and said zoning approval is contingent upon all conditions specified under accompanying use permit UP90-22 or future amendments. (b) This approval shall be valid for 18 months or until September 4, 1992, and shall become null and void if the site is not occupied by that date pursuant to conditions of the UP90-22.
