RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN
RAFAEL UPHOLDING AN APPEAL OF THE PLANNING, COMMISSION'S
CONDITIONAL APPROVAL OF A USE PERMIT TO ESTABLISH A
SECOND DWELLING UNIT IN A DETACHED ACCESSORY
STRUCTURE AT 56 MEADOW AVENUE.

WHEREAS, a use permit application was submitted to allow the conversion
of a detached accessory structure into a second dwelling unit at 56 Meadow Avenue;
and
WHEREAS, the Planning Commission reviewed the proposed project and
considered all reports, letters, recommendations and testimony at the regular
meeting of October 10, 1989, and voted to approve the proposed use permit; and
WHEREAS, the City Council of the City of San Rafael conducted a public
hearing on December 18, 1989, to consider an appeal of the Planning Commission's
conditional approval of the use permit, and considered all reports, letters,
recommendations and testimony.
NOW, THEREFORE BE IT RESOLVED, that the City Council of the City of San
Rafael hereby denies Use Permit 89-55 for a second dwelling unit at 56 Meadow
Avenue based upon the following finding:
(1) The establishment, maintenance and operation of the proposed use will
under the circumstances of this particular case, be detrimental to the
health, safety, peace, comfort and general welfare of persons in the
neighborhood as the use may generate additional parking in excess of the
available on-site parking, and therefore exacerbate the existing on -
street parking problem. Additional on -street parking and congestion
will increase the accident risk to vehicular and pedestrian traffic and
adversely affect emergency vehicular access.
I, JEANNE M. LEONCINI, Clerk of the City of San Rafael, hereby certify
that the foregoing resolution was duly and regularly introduced and adopted at a
regular meeting of the Council of said City on TUESDAY , the 16TH
day of JANUARY , 1990, by the following vote, to wit:
