HomeMy WebLinkAboutCC Resolution 8123 (East SR Neighborhood Plan)RESOLUTION NO. 8123 RESOLUTION OF THE SAN RAFAEL CITY COUNCIL CERTIFYING A NEGATIVE DECLARATION FOR THE EAST SAN RAFAEL NEIGHBORHOOD PLAN GENERAL PLAN AMENDMENT WHEREAS, on December 18, 1988, the City Council adopted a work program for the East San Rafael Neighborhood Plan noting that the recently adopted General Plan would be used as the basis for most land use and intensity decisions; circulation standards and improvement needs; and recreation, affordable housing, major environmental protection and safety standards; and that the Neighborhood Plan would address more specific, unresolved issues of neighborhood concern. WHEREAS, a draft Neighborhood Plan was prepared with the assistance of a Neighborhood Advisory Committee which proposed new neighborhood services and other policy and program additions; and WHEREAS, proposed new and revised programs and policies necessitated a General Plan Amendment and a new environmental assessment; and WHEREAS, an environmental assessment for program and policy changes resulting in a Negative Declaration of Environmental Impacts, was prepared in September, 1989, and circulated for 30 days, with no comments received. NOW THEREFORE BE IT RESOLVED, the environmental assessment identified no significant environmental impacts resulting from new policies and programs, with incorporation of program ESR-gggg to assure appropriate cleanup of City owned property at the end of Bellam Blvd. The San Rafael City Council approves certification of the Negative Declaration of Environmental Impacts per section 15168 (d) of the California Environmental Quality Act Guidelines for the East San Rafael Neighborhood Plan General Plan Amendment, with inclusion of ESR-gggg. nU R I gu"' I N A L 8,;, BE IT FURTHER RESOLVED, that upon review and consideration of the environmental assessment, draft Neighborhood Plan and other documents prepared as part of the Neighborhood Plan process, the City Council recommends making the following finding in accordance with Section 15092 of the CEQA guidelines: The Neighborhood Plan revision to the General Plan includes a reduction in the number of housing units from the San Rafael General Plan 2000 (Adopted July, 1988) for the following reasons: Elimination of a portion of the 6.14 acre City site at the end of Bellam Blvd. for housing was made in response to hazardous materials testing of the site which found hazardous levels of lead on the site, and because increased population in the neighborhood increases the need, under City park standards, for additional neighborhood parkland with the City site being the only remaining site available and accessible to the neighborhood to provide adequate parkland.
