RESOLUTION OF THE SAN RAFAEL CITY COUNCIL AUTHORIZING
THE MAYOR TO SIGN THE MEMORANDUM OF UNDERSTANDING
FOR JOINT CITY AND COUNTY INTEGRATED WASTE
MANAGEMENT PLANNING
WHEREAS, AB 939 requires each city and county to prepare, adopt, and implement
source reduction and recycling elements and requires the County to prepare a
countywide siting element and a county integrated waste management plan; and
WHEREAS, AB 939 enables cities and the county to jointly prepare the above-
mentioned elements and plans; and
WHEREAS, the cities and county have successfully jointly worked on waste
management issues in the past.
NOW, THEREFORE BE IT RESOLVED, that the City Council of the City of San
Rafael authorizes the mayor to sign the Memorandum of Understanding for Joint
County and City Integrated Wast Management Planning and Implementation.

foregoing Resolution was duly and regularly introduced and adopted at a regular
meeting of the Council of said City on Monday, the 7th day of May

MEMORANDUM OF UNDERSTANDING
FOR JOINT COUNTY AND CITY
INTEGRATED WASTE MANAGEMENT PLANNING AND IMPLEMENTATION
THIS AGREEMENT is made and entered into this day of , 1990, by
and between the COUNTY OF MARIN (COUNTY) and the CITIES OF BELVEDERE,
LARKSPUR, MILL VALLEY, NOVATO, SAN RAFAEL, and SAUSALITO and TOWNS OF
CORTE MADERA, FAIRFAX, ROSS, SAN ANSELMO, and TIBURON (CITIES), which are
municipal corporations within the COUNTY.
WHEREAS State Assembly Bill 939 (Sher, 1989) requires the COUNTY and each of its
CITIES to prepare, adopt, and implement source reduction and recycling elements and
requires the COUNTY to prepare a countywide siting element and a county integrated
waste management plan (Sections 41000 to 43000 of the Public Resources Code); and
WHEREAS the COUNTY and CITIES believe that it is mutually beneficial to jointly
prepare the above-mentioned elements and plans; and
WHEREAS AB 939 enables the COUNTY and CITIES to enter into a memorandum of
understanding for the express purpose of preparing and implementing the above-
mentioned elements and plans (Section 41823 of the Public Resources Code); and
WHEREAS AB 939 requires the COUNTY to convene a task force to guide the
development of CITY source reduction and recycling elements and the countywide siting
element and the task force's membership is to be approved by the COUNTY and a
majority of the CITIES (Section 40950 of the Public Resources Code), and there is an
established Marin County Waste Management Advisory Committee with representatives
of the COUNTY, CITIES, solid waste industry, environmental organizations, and the
public -at -large; and
WHEREAS AB 939 requires the COUNTY and CITIES to demonstrate a funding source for
preparing, adopting, and implementing the above-mentioned element and plans and
authorizes the COUNTY and CITIES to impose solid waste fees for this purpose (Sections
41900, 41901 and 41902 of the Public Resources Code);
NOW, THEREFORE, the parties hereto agree as follows:
1. Joint Plan. The COUNTY and CITIES will jointly prepare and implement a source
reduction and recycling element, countywide siting plan, and county integrated
waste management plan in accordance with AB 939 and related statutes; and
2. Management. The COUNTY shall act as manager of the joint planning and
implementation effort; and
4. Task Force. The Marin County Waste Management Advisory Committee shall act as
the task force for guiding the development and implementation of the above-
mentioned element and plans; and
5. Plan Adoption. The COUNTY and each CITY shall individually approve the source
reduction and recycling element, countywide siting element, and county integrated
waste management plan prior to their submittal to the State; and

6. Funding. Funding for this effort shall be solid waste fees collected by solid waste
haulers in Marin County, and -the COUNTY and CITIES agree to approve
corresponding garbage rate increases via their solid waste franchise agreements; and
7. Progress Reports. The COUNTY shall provide progress reports on the status of the
above-mentioned element and plans and their implementation to each CITY on each
anniversary of this agreement; and
8. Withdrawal. Any CITY may withdraw from this agreement upon sixty (60) days
written notice to the COUNTY and each CITY. Upon withdrawal, a CITY retains its
financial obligations for current contracts executed to fulfill this agreement,
assumes responsibility for the CITYS obligations as a city under AB 939, and
assumes that responsibility at its own expense; and
9. Amendments. This agreement may be amended only upon the affirmative vote of
the COUNTY and all signatory CITIES; and
10. Termination. This agreement shall continue until terminated by amendment or until
January 1, 2000, whichever is earlier.
