RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN
RAFAEL ACCEPTING CONVEYANCE OF OPEN SPACE LANDS
WITHIN OAKWOOD SUBDIVISION UNITS 2 AND 3
WHEREAS, the public interest, convenience, necessity and welfare require
that the real property hereinafter mentioned within Oakwood Subdivision Units 2 and 3
be accepted and used for the benefit of the public of the City of San Rafael, California, for
use as open space only.
NOW, THEREFORE BE IT RESOLVED that the City Council of the City of
San Rafael, California, does hereby accept that certain deed from Paul J. Felton, dated May
16, 1988, for and on behalf of the City of San Rafael and the real property described therein,
attached hereto and incorporated herein by reference, and the Clerk of said City is hereby
directed to cause said deed to be duly recorded in the office of the County Recorder of the
County of Marin, State of California, forthwith upon the adoption of this resolution.
I, JEANNE. M. LEONCINI, Clerk of the City of San Rafael, hereby certify that
the foregoing resolution was duly and regularly introduced and adopted at a regular
meeting of the Council of said City on Monday, the 18th day of June, 1990, by the following
vote, to wit:

ALL that certain parcel of land designated as "Upper Toyon Open Space" on
that certain map entitled, 'Oakwood Unit No. 3", filed for record April 11,
1984 in Volume 19 of Maps, at page 12, Marin County Records.
THIS DEED IS GIVEN UPON THE EXPRESS CONDITION THAT BOTH PARCELS SHALL
CONTINUE TO BE USED IN PERPETUITY FOR OPEN SPACE USES ONLY.
