RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN RAFAEL DENYING
THE APPEAL OF THE PLANNING COMMISSION'S DENIAL OF UP89-36, A USE
PERMIT FOR A SECOND DWELLING UNIT AT 7 AND 9 ALVINA AVENUE
WHEREAS, UP89-36 was submitted in June of 1989, to demolish an existing duplex
structure and replace it with a single family residence and second unit; and
WHEREAS, the use permit application is exempt from environmental review per
Section 15303(a) of the California Environmental Quality Act; and
WHEREAS, the Planning Commission considered UP89-36 on April 10, 1990, and
continued the item for further review; and
WHEREAS, the Planning Commission considered UP89-36 on April 24, 1990, and
continued the item; and
WHEREAS, the Planning Commission considered UP89-36 on May 15, 1990, and
denied the project; and
WHEREAS, the matter was then appealed to the City Council and the City Council
heard the matter at a duly noticed public hearing on July 2 and denied the appeal of
the Planning Commission's denial.
NOW, THEREFORE, BE IT RESOLVED, that the San Rafael City Council hereby
denies the appeal of the Planning Commission's denial of a second dwelling unit at
7 and 9 Alvina Avenue and denies the use permit application (UP89-36) based on
the following findings:

1. The proposed location of the conditional use is not in accord with the
objectives of this title, and purpose of the district in which the site is located.
The proposal is inconsistent with General Plan Policies LU -10 (Density of
Residential Development), LU -19 (Design Approach), LU -34 (Residential Site
Design), in that the substandard lot size is a site constraint which limits the
site density, the size of the project is inconsistent with the development
pattern in the neighborhood and the proposed size of the structure is too large
for the substandard lot (4,800 sq. ft., where 5,000 sq. ft. is required).

foregoing resolution was duly and regularly introduced and adopted at a REGULAR
meeting of the City Council of said City held on MONDAY the 16th
day of JULY , 1990, by the following vote, to wit:
