NOW, THEREFORE, BE IT RESOLVED, that the San Rafael City Council hereby denies the appeal of the Planning Commission's denial of a second dwelling unit at 7 and 9 Alvina Avenue and denies the use permit application (UP89-36) based on the following findings: b SS S :t 17 ?,? a6- 1. The proposed location of the conditional use is not in accord with the objectives of this title, and purpose of the district in which the site is located. The proposal is inconsistent with General Plan Policies LU -10 (Density of Residential Development), LU -19 (Design Approach), LU -34 (Residential Site Design), in that the substandard lot size is a site constraint which limits the site density, the size of the project is inconsistent with the development pattern in the neighborhood and the proposed size of the structure is too large for the substandard lot (4,800 sq. ft., where 5,000 sq. ft. is required). I, JEANNE M. LEONCINI, Clerk of the City of San Rafael, hereby certify that the foregoing resolution was duly and regularly introduced and adopted at a REGULAR meeting of the City Council of said City held on MONDAY the 16th day of JULY , 1990, by the following vote, to wit: AYES: COUNCILMEMBERS: Breiner, Shippey, Thayer & Mayor Mulryan NOES: COUNCILMEMBERS: None ABSENT: COUNCILMEMBERS: Boro dz-sl- A4 .
