RESOLUTION OF INTENTION TO VACATE SANITARY
SEWER EASEMENT AT 69 CHULA VISTA DRIVE, SAN
RAFAEL, CALIFORNIA (A.P. NO. 11-011-14)
WHEREAS, it appears that the easement hereinafter described
is unnecessary for present or prospective public use;
NOW, THEREFORE, IT IS HEREBY RESOLVED AS FOLLOWS:
1. That the City Council of the City of San Rafael,
California, hereby elects to proceed under the PUBLIC SERVICE EASEMENTS
VACATION LAW of the State of California;
2. That the City Council of the City of San Rafael,
California, hereby declares its intention to close, vacate and abandon
the easement hereinafter described;
3. That Monday, 2nd day of October, 1989, at 8:00 o'clock
P.M., in the Council Chambers at the City Hall in the City of San
Rafael, California, is hereby set as the time and place for hearing
all persons interested in the proposed closing, abandoning and vacation
of said easement.
4. That the Department of Public Works of the City of
San Rafael shall post conspicuously notices of easement vacation
along the line of said easement proposed to be closed, abandoned
and vacated, which notices shall be posted not more than three hundred
free apart, but at least three notices shall be posted as to each
such easement proposed to be closed, abandoned and vacated. The
said notice shall state the time and place of the hearing, as herein-
above provided, and the adoption of the within resolution of intention.
5. That said easement proposed to be closed, abandoned
and vacated is described on Exhibit "A", which is attached hereto
and incorporated herein by reference.
6. That a map or plan showing said easement proposed
to be closed, abandoned and vacated, is on file in the office of
the City Clerk of the City of San Rafael at the City Hall, San Rafael,
California.

I, JEANNE M. LEONCINI, Clerk of the City of San Rafael,
California, hereby certify that the foregoing resolution was duly
and regularly introduced and adopted at a regular meeting of the
Council of said City held on the 5th day of September, 1989, by the
following vote, to wit:

Being a portion of a 10 -foot wide sanitary sewer
easement described in a Deed of Easement from Doris L.
and Ralph L. Coffing to the City of San Rafael, re-
corded December 19, 1963 in Book 1761, at page 48
et seq. Marin County Records, described as follows:
Beginning at the southwest corner of the lands conveyed by Hadden N. Salt
at ux to Simon N. Palmer et ux by deed recorded February 27, 1980 in Book
3682 of Official Records at page, 434, Marin County Records: running
thence from said point of beginning along the westerly line of the lands
conveyed to Palmer North 12035' West 10.06 ft.; thence leaving said line
North 83054' East 68.52 ft. and South 16024' West 10.824 ft. to a point in the
southerly line of the aforesaid lands conveyed to Palmer, which point is the
northeast corner of the lands conveyed by Philip Lesh to Philip Lesh and
Jillspeth W. Lesh by deed recorded October 9, 1984 by Document No. 84-
47787, Marin County Records; thence along said southerly line South 83054'
West 63.24 ft. to the point of beginning.
