HomeMy WebLinkAboutCC Resolution 8059 (San Quentin Work Program)RESOLUTION NO. 8059 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN RAFAEL AUTHORIZING THE SIGNING OF A CONTRACT, LEASE OR AGREEMENT THE CITY COUNCIL OF THE CITY OF SAN RAFAEL RESOLVES as follows: The CITY MANAGER and CITY CLERK are authorized to execute, on behalf of the City of San Rafael, a one year agreement extension from September 15, 1989 through September 14, 1990 and any future yearly extensions with the CALIFORNIA DEPARTMENT OF CORRECTIONS - SAN QUENTIN STATE PRISON for state prisoners to participate in a work program. The ongoing cost to the City of San Rafael will be a $35.00 monthly charge for the City's share of a portable toilet facility, a copy of which is hereby attached and by this reference made part hereof. I, JEANNE M. LEONCINI, Clerk of the City of San Rafael, hereby certify that the foregoing resolution was duly and regularly introduced and adopted at a regular meeting of the Council of said City on Monday , the Second day of October , 1989, by the following vote, to wit: AYES: COUNCILMEMBERS: Boro, Breiner, Frugoli, Thayer & Mayor Mulryan NOES: COUNCILMEMBERS: None ABSENT: COUNCILMEMBERS: None EANNE M.�LE0kCI I, C y( 1 ��IGIN�I M a Agreement between Marin Cities and the California Department of Corrections, San Quentin State Prison WHEREAS, San Quentin State Prison has available a varying number of fully able-bodied inmates which it is desirous of training and effectively utilizing in a regular program of productive work as mandated by the State in under Assembly Bill 1403, and WHEREAS, Marin Cities can effectively utilize inmates for work projects, and WHEREAS, parties hereto desire to cooperate with each other in an understanding that will accomplish various maintenance projects within the Cities and the training and employment of men herein before set forth, THEREFORE, it is mutually agreed as follows: ARTICLE I - MARI`I CITIES RESPONSIBILITIES Marin Cities agree to: 1. Assist institution in establishing the necessary cooperative law enforcement net`'70rk or empr-ency ,rovl.':2 ' �-anspoi t �:_. a.L seriously injured inmates to the nearest medical facility. 2. Assist in protecting community safety and security by - informin� local law enforcement of crew lo.-ation for the purpose of providing periodic patr-)l or for escape pursuit. 3. Provide general direction an.! instructions for all work projects to be completed by San Quentin State Prison inmates. 4. Provide any equipment necessary for the completion of projects. S. Provide all tools for completion of projects; i.e., chain saws, wrenches, air compressors, and fuel for such tools. 6. Provide technical direction to inmates for the safe operation of any special equipment for completion of projects. 7. Provide first aid training for inc-reasin;_,the'•stafety of inmates, staff, and the community at large. Ai;TICLE III (CONTINUL_. 3. The work force, agents and employees of San Quentin State Prison, who are provided to Marin Cities, are not and shall not under any circumstances be considered employees or agents of Marin Cities. ARTICLE IV - WORK CREW VEHICLE 1. The prison has accepted title from the Town of Fairfax for the 1931 Dodge Van, license _ICGY537, currently being used by the prison for the Marin Cities Community TJ fork Program, subject to the following conditions: a. Cities will continue to assume all costs for fuel and maintenance of said vehicle in order to keep it in safe operating condition, except that cities have final authority on whether repairs will be made. The cities further understand that any failure to repair the van will have the adverse effect of shutting down the program. b. Prison reserves right to not use van for transporting inmates if any requested repairs not made -render the vehicle in their judgement unsafe for transportation of the inmates. C. Cities agree that prison will retain title to vehicle e,.�er iF d1..Sr .`--lUer1 'Or t10rt p_. `:'1,' time because ofl ''Ioc: down" or other special circumstances of the prison, and that the prison will retain title to vehicle even if inmate work program is discontinued permanently. 2. It is understood that prison assumes full liab.7-ity for the vehicle and agrees to hold the cities or its =_mployees or agents harmless for any incidents, injuries, or accidents as a result of operating said vehicle. ARTICLE V - LENGiTH OF AGREEMENT This agreement entered into on or about September 15, 1939 shall continue in effect for a period of one (1) year from the date first herein above written, unless cancelled or amended by mutual consent of the parties hereto upon thirty (30) days written notice by either party. It is mutually agreed that there shall be no payment involved in this agreement.
