RESOLUTION ORDERING CLOSING, ABANDONING AND VACATING
PORTION OF EXISTING SANITARY SEWER EASEMENT AT
69 CHULA VISTA DRIVE, SAN RAFAEL, CALIFORNIA
(A.P. NO. 11-011-14)
WHEREAS, the City Council of the City of San Rafael on
the 5th day of September, 1989, adopted Resolution No. 8026 entitled,
RESOLUTION OF INTENTION TO VACATE SANITARY SEWER EASEMENT AT 69
CHULA VISTA DRIVE; and
and
WHEREAS, said Resolution was posted as required by law;
WHEREAS, the Department of Public Works of the City of
San Rafael, California, conspicuously posted notices of easement
vacation as required by law; and
WHEREAS, a hearing was had this day as required by law
and said Resolution No. 8026, at which hearing the Council of the
City of San Rafael heard evidence offered by persons interested;
and
WHEREAS, it appears from all of the evidence submitted
that the following described easement area is unnecessary for present
or prospective public use;
NOW, THEREFORE, IT IS HEREBY RESOLVED as follows:
1. That the following described easement area is unneces-
sary for present or prospective public use;
2. That the following described easement area is hereby
ordered closed, abandoned and vacated;
3. That the easement area closed, abandoned and vacated
is described on Exhibit "A" which is attached hereto and incorporated
herein by reference.
I, JEANNE M. LEONCINI, Clerk of the City of San Rafael,
California, hereby certify that the foregoing resolution was duly
and regularly introduced and adopted at a regular meeting of the
Council of said City held on the 2nd day of October, 1989, by the
following vote, to wit:

Being a portion of a 10 -foot wide sanitary sewer
easement described in a Deed of Easement from Doris L.
and Ralph L. Coffing to the City of San Rafael, re-
corded December 19, 1963 in Book 1761, at page 48
et seq. Marin County Records, described as follows:
Beginning at the southwest corner of the lands conveyed by Hadden N. Salt
et ux to Simon N. Palmer et ux by deed recorded February 27, 1980 in Book
3682 of Official Records at page 434, Marin County Records: running
thence from said point of beginning along the westerly line of the lands
conveyed to Palmer North 12035' West 10.06 ft.; thence leaving said line
North 83054' East 68.52 ft. and South 16°24' West 10.824 ft. to a point in the
southerly line of the aforesaid lands conveyed to Palmer, which point is the
northeast corner of the lands conveyed by Philip Lesh to Philip Lesh and
Jillspeth W. Lesh by deed recorded October 9, 1984 by Document No. 84-
47787, Marin County Records; thence along said southerly line South 83°54'
West 63.24 ft. to the point of beginning.
