HomeMy WebLinkAboutCC Resolution 8063 (Silviera Parkway)RESOLUTION NO. 8063 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN RAFAEL APPROVING AND CERTIFYING A NEGATIVE DECLARATION FOR A 102 - BED PERSONAL CARE FACILITY TO BE LOCATED WEST OF SILVEIRA PARKWAY ON ASSESSOR'S PARCEL 155-251-52, AND IN CONNECTION WITH APPROVALS FOR REZONING (Z89-12), SECOND AMENDMENT TO DEVELOPMENT AGREEMENT (P89-7) USE PERMIT (UP89-37), DESIGN REVIEW PERMIT (ED89-47) AND LOT LINE ADJUSTMENT (s89-19). WHEREAS, Tishman Speyer Mediq Marin Limited has filed applications for approval of a 102 -bed Personal Care facility, consisting of City files Z89-12, P89-7, UP89-37, ED89-47 and s89-19; and WHEREAS, On September 12, 1989, the Planning Commission adopted Resolution No. 89-25 recommending City Council approval of a Negative Declaration in connection with recommendations for City Council approval of rezoning (Z89-12) and a Second Amendment to a Development Agreement (P89-7); and WHEREAS, the City Council has reviewed and considered the minutes of the September 12, 1989 Planning Commission meeting during which public comments upon the Negative Declaration could be presented, the staff report to Planning Commission for the September 12, 1989 meeting and the Negative Declaration; and WHEREAS, on October 2, 1989 the City Council conducted a noticed public hearing at which public comment upon the Negative Declaration was solicited; NOW THEREFORE BE IT RESOLVED, that the San Rafael City Council concurs in the recommendation of the Planning Commission for approval of the Negative Declaration; and BE IT FURTHER RESOLVED, that the San Rafael City Council finds there is no substantial evidence in the record showing that the project may have a significant effect upon the environment, and approves the Negative Declaration.
