A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN RAFAEL
CERTIFYING A NEGATIVE DECLARATION FOR AN
ORDINANCE TO AMEND TITLE 14 (ZONING)
OF THE MUNICIPAL CODE FOR REZONING OF PROPERTY
LOCATED AT 855 " C" STREET
TO P -D (PLANNED DEVELOPMENT) DISTRICT FOR DEVELOPMENT OF
60 RESIDENTIAL UNITS
(AP 11-2544-18 AND 07)
("CENTERTOWN" PROJECT)
WHEREAS, a zone change application was submitted on
behalf of Centertown Associates and Bridge Housing to rezone
property at 855 " C" Street; and
WHEREAS, an Initial Environmental Study was prepared
in accordance with the State EIR Guidelines to assess potential
environmental impacts of the proposal; and
WHEREAS, on April 25, 1989 the Planning Commission
found that the amendment would not create any significant adverse
impacts and recommended to the City Council ( 5-0 ) the Certification
of a Negative Declaration;
WHEREAS, after the Planning Commission action, evidence
of petroleum product leakage was discovered on the site and soils
testing and remediation work was done and another Initial
Environmental Study was prepared in accordance with the State EIR
Guidelines to assess potential environmental impacts of the proposal;
and
WHEREAS, after preparation of the second Initial
Environmental Study, staff found that the amendment would not
create any significant adverse impacts and recommended to the City
Council the Certification of a Negative Declaration;
NOW, THEREFORE, BE IT RESOLVED that the San Rafael
City Council finds there is no substantial evidence in the record
showing that the project may have a significant effect on the
environment and certifies the Negative Declaration for an Ordinance
to amend Title 14 (Zoning) of the Municipal Code by rezoning the
subject property to P -D (Planned Development) District.
