A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN RAFAEL
APPROVING A NEGATIVE DECLARATION FOR A GENERAL PLAN AMENDMENT,
A REZONING AND A USE PERMIT, AND APPROVING A GENERAL PLAN
AMENDMENT (GPA 89-1) FOR PROPERTY TO BE USED FOR RECYCLING
ACTIVITIES, LOCATED ON JACOBY STREET, APN 18-180-48 AND 18-141-
03.
(MARIN SANITARY SERVICE)
WHEREAS, on November 14, 1989, the Planning Commission
adopted Resolution No. 89-30 (incorporated herein by reference)
which recommended approval by the City Council of a Negative
Declaration, a General Plan Amendment (GPA 89-1) and a Rezoning
(Z89-6), and which Resolution granted Planning Commission
approval of a Use Permit (UP 89-19) for Marin Sanitary Service;
and
WHEREAS, the City Council has been furnished Planning
Commission Resolution No. 89-30, a Negative Declaration Updated
November 15, 1989 and a Staff Report to Mayor and City Council
for the November 20, 1989 City Council meeting (Council Report)
which Council Report included a Staff Report to the Planning
Commission for the October 10, 1989 Planning Commission
meeting, minutes of the October 10 and 24, 1989 Planning
Commission meetings and other information; and
WHEREAS, the recommended General Plan Amendment GPA 89-1
consists of a change to the General Plan 2000 Land Use map as
shown on Exhibit "A" attached hereto and an amendment to
General Plan 2000 policy ESR -31 as shown on Exhibit "B"
attached hereto; and
WHEREAS, on November 20, 1989, the City Council held a
noticed public hearing to accept and consider public comment on
the Negative Declaration, the General Plan Amendment and the
Rezoning;
NOW THEREFORE BE IT RESOLVED, the City Council finds it
has reviewed and considered all the information furnished for
the November 20, 1989 City Council public hearing, including
the Negative Declaration and comments and other information
presented during the November 20, 1989 public hearing; and
BE IT FURTHER RESOLVED, the City Council approves and
adopts as its own those findings recommended by Planning
Commission Resolution No. 89-30; and
BE IT FURTHER RESOLVED, the City Council finds on the

basis of the Initial Study and the comments received that there
is no substantial evidence that the project will have a
significant effect upon the environment, and therefore the City
Council approves and adopts the Negative Declaration; and
BE IT FURTHER RESOLVED, pursuant to the findings contained
in Planning Commission Resolution No. 89-30 the City Council
approves General Plan Amendment GPA 89-1 as shown on Exhibits
"A" and "B".

certify that the foregoing resolution was duly and regularly
introduced and adopted at a regular meeting of the Council of
said City on MONDAY , the 20th day of NOVEMBER
1989, by the following vote, to wit:

EXHIBIT "B"
General Plan 2000 policy ESR -31 is hereby amended to read in
full as follows:
"ESR -31 San Quentin Ridge. Preserve San Quentin Ridge as open
space through the development process due to its
visual significance, importance as a community
separator, slope stability problems and wildlife
habitat value. The exact delineation of
"conservation" and "development" portions of the site
on the land use map is schematic, with development
limited to the lower, less steep portion of the site.
Upon termination of use by Marin Sanitary Service for
Recycling activities of the lower less steep portions
of the site, which portions are designated
"Industrial" on the land use plan, the City shall
consider redesignation of these portions to "Light
Industrial/Office".
