A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN RAFAEL
CERTIFYING AN EIR REGARDING A PROPOSED REZONING FROM U
(UNCLASSIFIED) TO P -D (PLANNED DEVELOPMENT) (Z 87-3), A USE
PERMIT (UP 89-40), A VESTING TENTATIVE MAP (TS 89-3) AND A
DESIGN REVIEW PERMIT (ED 89-50) FOR A 21 -UNIT RESIDENTIAL
PROJECT (THE PROJECT) TO BE LOCATED AT THE TERMINUS OF ORCHID
DRIVE, APN 178-061-01.
(THE HIGHLANDS)
WHEREAS, on November 14, 1989, the Planning Commission
adopted Resolution 89-31 (incorporated herein by reference)
which recommended the City Council certify a Final EIR and
approve Rezoning Z87-3 for the project and which resolution
granted Planning Commission conditional approval of Use Permit
UP89-40, Vesting Tentative Map TS89-3, and Design Review permit
ED89-50; and
WHEREAS, the City Council has been furnished copies of
Planning Commission Resolution 89-31, the Final EIR and a Staff
Report to the Mayor and City Council for the December 4, 1989
meeting (Council Report) which Council Report includes a Staff
Report to the Planning Commission for the October 24, 1989
Planning Commission meeting, minutes of the October 24, 1989
Planning Commission meeting and other information; and
WHEREAS, on December 4, 1989 the City Council held a
noticed public hearing to accept public comment, to consider
certification of the Final EIR and to consider approval of
Rezoning Z87-3;
NOW THEREFORE BE IT RESOLVED, the City Council finds it
has reviewed and considered the information furnished for the
December 4, 1989 meeting together with public comment and other
information provided during the December 4, 1989 City Council
hearing; and
BE IT FURTHER RESOLVED, the City Council approves and
adopts as its own the findings recommended in Planning
Commission Resolution 89-31; and
BE IT FURTHER RESOLVED, the City Council finds the Final
EIR shall consist of the information as recommended in
Planning Commission Resolution 89-31 together with minutes of
the October 24, 1989 Planning Commission meeting, this City
Council Resolution, the Council Report and the minutes of the
December 4, 1989 City Council public hearing; and

BE IT FURTHER RESOLVED, the City Council certifies the
Final EIR has been completed in compliance with the California
Environmental Quality Act; the City Council certifies the Final
EIR was presented to the City Council which is the decision-
making body of the Lead Agency; and the City Council certifies
it has reviewed and considered the information contained in the
Final EIR prior to taking action to approve Rezoning Z87-3; and
BE IT FURTHER RESOLVED, this resolution shall take effect
upon its adoption.

hereby certify that foregoing resolution was duly and regularly
introduced and adopted at a regular meeting of the Council of
said City on MONDAY , the 4t -h , day of DECEMBER ,
1989, by the following vote, to wit:
