HomeMy WebLinkAboutCC Resolution 8099 (Housing Element Consulting)RESOLUTION 110. 8099 A RESOLUTION OF THE SAN RAFAEL CITY COUNCIL APPROVING A $10,000 CONTRACT WITH THE FIRM OFJEFFREY BAI RD & ASSOCIATES (herinafter Consultant) WHEREAS, the City Council approved the Housing Element Update Work Program on November 6, 1989; and WHEREAS, requests for proposals were solicited and one firm responded;and WHEREAS, Jeffrey Baird & Associates has completed prior Housing Element and General Plan work for the City of San Rafael and is eminently qualified to complete this task; and WHEREAS, this firm's work has been of consistent high quality. NOW, THEREFORE BE IT RESOLVED, effective December 18, 1989, the City Council hereby adopts an agreement with Consultant to update the San Rafael Housing Element consistent with the work program, attached hereto. LEONCINI, City Clerk �, EXHIBIT A This AGREEMENT is made and entered into this 18th day of December, 1989, by and between the CITY OF SAPS RAFAEL (herinafter referred to as City) and JEFFREY BAIRD °ASSOCIATES (herinafter called Consultant) A. Scope of Work: In accordance with this Agreement, the Consultant agrees to provide contract planning services for updating the Housing Element as outlined in the attached work program (See Attachment A) The consultant agrees to be available to perform the work specified in this Agreement in the time frames specified. B. Direction: The consultant, in performance of the Scope of Work referred to above, will work under the direction of the City's Planning Director or the Director's appointed representative. It is understood and agreed that the Consultant is, and at all times shall be, an independent contractor and nothing contained herein shall be construed as making the Consultant, or any individual whose compensation for services is paid by the Consultant, an agent or employee of the City, or authorizing the Consultant to create or assume an obligation for or on behalf of the City. C. Payment For the payments specified herein, which the City agrees to make, the Consultant will undertake the above noted work. Payment of contract planning work shall be as follows: (1) The Consultant shall receive a total of $2,000 within one month of the start of contract, $2,500 after completion of data collection, $3,000 upon completion of a draft Housin Element., and $2,000 upon completion of a final revised Housinq Elemen17. D. Terms The terms of this Agreement shall be through September, 1990. Either party may terminate, with or without cause, by giving the other party thirty (30) days written notice. In the event of Agreement termination, City shall pay consultant all sums then due and unpaid under this Agreement. Payment by City of such sums shall be considered full and final settlement for all work performed by the Consultant under this Agreement, All completed reports and other documents and materials described in Attachment A shall become the property of the City. AS TO C:Ot-)-.iTEr T �_i PE�.1 I EY, Plann(nqy ector 4 ATTACHMENT A CONSULTING SERVICES AGREEMENT BETWEEN THE CITY OF SAN RAFAEL AND JEFFREY BAIRD ASSOCIATES FOR UPDATING THE SAN RAFAEL HOUSING ELEMENT. A. SCOPE OF SERVICES. TASKS 1) Review California Housing Element law 2) Review existing adopted Housing Element for compliance with State law. Cursory review of rest of General Plan for overview of available related data. 3) Conduct needed revisions including a) clarification of amount of high density land available for lower income housing consistent with City/HCD correspondence on this i slue. b) expansion of the description of the City's fair housing program. consistent with prior City/HCD correspondence on this issue. c) Incorporation of the most recent new construction regional share figu res prepared by ABAG in its 1989 "Housing Needs Deteririirlations". d) An updated analysis and documentation of household characteristics including level of payment compared to ability to pay, housing characteristics, including overcrowding, and housing stock condition. e) Review of new manufactured housing provisions requiring changes to the city's manufactured housing ordinance. f) Inclusion of Residential Care Facilities task force recommendations about emergency shelters and transitional housing within the City. g) Inclusion of any revisions as a result of ongoing Below Market Rate guidelines program h) Updating of the "potential facilities constraints" section to take into account potential water, sewage treatment, and highway capacity constraints which may affect timing of new residential construction. i) Updating of certain other housing characteristics such as vacancy rates, building activity information, and the low and moderate income 5 units chart. T) Evaluation of second unit program for affordability and to consider possible limits on maximum size of units to protecting neighborhoods, 4) Review the latest adopted Housing Element to evaluate the effectiveness of its programs, progress in implementation, and appropriateness of policies and programs based on the review. The revised element must reflect the results of this review in the revised element and analyze updated housing needs, including housing needs deterl-I-Onatlons 5) Meet with Ecumenical Association for Housing, the Marin Housing Authority, San Rafael Housing Corporation representatives to review results of analysis and potential revisions/additions to programs 6) Revise existing housing programs/policies as needed to increase effectiveness in meeting housing needs. 7) Prepare Draft amended Housing Element. 8) Review General Plan for internal consistency. Meetings: The consultant will be expected to meet with City staff to review available data, etc. If necessary, the consultant shall meet at least once with State HCD staff. The consultant is also expected to meet with Housing groups, either together or separately, and attend up to two Planning Commission and one City Council meetings. Products: The consultant shall provide needed information to meet with staff and housing groups, a camera ready draft Plan and a camera ready copy of the final adopted Plan. Timetable: First week January, 1990. Consultant to start work January -March. Consultant review, data collection and analysis. March. Meet with housing groups to review needs/housing programs. Second week April. Draft amended Housing Element prepared and submitted to State Department of Housing and Community Development (HCD) for mandatory 45 day review. Second meeting May. Draft Housing Element to Planning Commission June. Draft Housing Element to City Council. July 1, 1990. Submit adopted Housing Element to HCD, A
